AUSTIN COUNTY ROAD LAW.
H. B. No. 109.] CHAPTER 3.
An Act to provide a Special County Road Law for Austin County, Texas;
declaring County Commissioners shall be Ex-officio Road Supervisors
of their respective Precincts and, subject to the direction of the Commissioners'
Court, have charge of all road equipment for the building and
maintenance of roads in their respective Precincts, and defining the
authority and duties of said Commissioners as Road Supervisors;
requiring bond of such Commissioners as Road Supervisors, and requiring
the keeping of certain accounts; providing for the purchase
of material and supplies necessary in the discharge of duties imposed,
and for the employment of necessary labor; providing a road tax
upon every person in the said County liable for road duty under the
General Laws of Texas, and providing the authority of the Road Supervisor
over each Commissioner's Precinct relative to such road tax;
providing restrictions upon the use of road equipment; providing a
penalty upon certain County and Precinct officials; providing this Act
shall be cumulative of General Road Laws of the State, and that this
Act shall control as to Austin County where not in direct conflict with
the General State Law; providing that if any part of this Act shall
be held unenforcible for any reason, the remainder shall be in full
force and effect; and providing that this Act become effective from
and after July 1, 1930.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That each County Commissioner of Austin County,
shall be and he is hereby declared Ex-officio Road Supervisor
of his respective Commissioners' Precinct and under the direction
of the Commissioners' Court he shall have charge of all teams,
tools, machinery and all property whatsoever belonging to Austin
County placed in his possession and under his control by
said Court, and it shall be his duty under such rules and regulations
as said Court may prescribe to superintend and supervise
the laying out of all new roads, the making of changes in
all established roads, and the building, repairing and construction
of public roads, bridges and culverts in his Precinct. And
it shall be his special duty to serve notice upon, or have notice
served upon, any and all persons in his Precinct subject to road
duty, as is hereinafter provided, notifying them of the time,
place and part of the public road or roads on which they are to
work, which notice shall be served in the same manner and for
fhe same length of time as is required by the General Laws of
the State of Texas to be served by road overseers upon persons
subject to road duty, and any person subject to road duty who
has failed to pay his road tax as hereinafter provided, and who
fails to report and work on the public road in accordance with
said notice, shall be subject to the same penalty as is provided
by the General Laws of the State of Texas for failure to work
a public road when so notified; and any person who is subject to
road duty, as hereinbefore provided, may be summoned to work
on any public road in the Commissioners' Precinct in which he
resides, not more than six miles from his residence, except the
