106 LOCAL AND SPECIAL LAWS.
Assessor of Austin County shall, at the time of assessing other
taxes, assess such road tax and shall, at the time of making and
extending his tax rolls, charge each person liable to road duty
under the General Laws of the State of Texas with said road tax
of Five ($5.00) Dollars, and he shall receive as compensation
therefor the same fees as allowed under the General Laws of
the State of Texas for assessing poll tax. A list of all persons
liable for road duty for the year 1931 and all subsequent years,
shall be arranged by said Tax Assessor in alphabetical order
by Commissioners' Precincts, and delivered to the County Treasurer
of Austin County, Texas, on or before the first day of October,
A. D., 1931, and each year thereafter.
SEC. 7. The County Treasurer of Austin County, Texas, shall
receive and receipt for all money so paid him, the same to be
placed to the credit of the Road and Bridge Fund of said County,
and a separate account shall be kept for each Commissioners'
Precinct from which said monies are received by the County
Treasurer. The receipts issued by him shall show the number
of the Commissioners' Precinct in which the person paying the
tax resides, and all such monies shall be used and expended
only in the Precinct in which the person paying the same resides.
SEC. 8 Every person liable for road duty under the General
Laws of the State of Texas relating to public roads and residing
in Austin County, Texas, who shall fail to pay said road tax, as
hereinbefore provided, to the County Treasurer of said County,
on or before the 31st day of January next after said road tax accrues,
as provided herein, shall be liable to, and it is hereby made
his duty and he shall be required to work upon, repair, clean out,
construct, and to do and perform any work which may be designated
by said Road Supervisor upon the roads, bridges, and
culverts in the Commissioner's Precinct in which he resides and
under the direction and supervision of the Road Supervisor in
such Precinct, or other person duly authorized by said Road Supervisor,
for five days in said year, for the road tax accruing the
year prior thereto, and shall report for duty at such time and
place on any public road in said Precinct within six miles of his
residence, as said Road Supervisor or other person authorized
may direct, when such persons shall have been given the legal
notice now provided for by the General Laws of the State of
Texas, which said notice shall be given by said Road Supervisor
or other person authorized by him in the same manner as notice
is required to be given under the General Laws of the State of
Texas by road overseers, and any person subject to road duty
who shall fail to work said roads when so notified after having
failed to pay the road tax hereinbefore provided, or fail to provide
an able-bodied substitute or pay to such Road Supervisor
the sum of One ($1.00) Dollar for each day summoned, shall be
subject to the same penalties provided by the General Laws of
the State of Texas for faliure to obey notice served upon him
by road overseers.
