shall ever be loaned by any Road Supervisor or other person to
any person, and it shall be unlawful for any such property
owned by the County to be used by any person for any private
purpose, and any person so offending shall be deemed guilty of
a misdemeanor, and upon conviction thereof in any Court of
Competent Jurisdiction, shall be fined in any sum not exceeding
Fifty ($50.00) Dollars, and each day's use of said property shall
constitute a separate offense, and it is hereby made the imperative
duty of each Road Supervisor to see that the provisions are
strictly enforced and observed.
SEC. 10. Any Road Supervisor, Tax Assessor, Tax Collector
or County Treasurer who fails to perform any of the duties required
of him under the provisions of this Act shall be deemed
guilty of a misdemeanor and upon conviction thereof, shall be
punished in any sum not less than Ten ($10.00) Dollars nor
more than One Hundred ($100.00) Dollars.
SEC. 11. This Act shall be taken notice of by all Courts in
the same manner as the General Laws of the State of Texas, and
shall be held cumulative of all General Laws' of this State on
this subject, when not in conflict with this Act, but in case of
conflict this Act shall control as to Austin County, Texas. This
Act shall be construed as specifically repealing House Bill No. 94
of the Local and Special Laws of the Fourth Called Session of
the 41st Legislature and all its provisions.
SEC. 12. Should it be judicially determined that any part of
this Act is unconstitutional, void, or unenforceable, the remainder
shall nevertheless be of full force and effect.
SEC. 13. This Act shall take effect and be in force from and
after July 1, 1930.
