public roads maintained by the State of Texas, on which road
he shall be apportioned or notified to work; provided that any
person subject to road duty under the General Laws of the State
of Texas, who shall pay his road tax as hereinafter provided,
shall be excused from such road duty.
It shall be the duty of each County Commissioner as such
Road Supervisor to file complaint against any person failing to
work the public road in his Precinct when notified as herein
provided, in any Court of Competent Jurisdiction, or to report
the same to the Grand Jury of Austin County, when that body
is in session.
SEC. 2. Each of said Commissioners shall before entering
upon his duty as Road Supervisor of his Precinct, execute bond
in the sum of One Thousand ($1,000.00) Dollars, with two or
more good and sufficient sureties, payable to the County Judge
of Austin County, Texas, and his successors in office, for the use
and benefit of the Road and Bridge Fund of said County, to be
approved by the County Judge of Austin County, Texas, and
conditioned that such Road Supervisor shall faithfully perform
all the duties of Road Supervisor required of him by law and
the rules and regulations prescribed by the Commissioners'
Court, and that he will account for all monies or property that
may come into his possession, or be placed under his charge,
belonging to said County.
SEC. 3. Such Road Supervisors, for the services required of
them under the law and the rules and regulations prescribed by
the Commissioners' Court, shall not recieve any compensation
in addition to the compensation received as Commissioners under
the General Laws of the State of Texas.
SEC. 4. Subject to the provisions of this Act, the Commissioners'
Court shall have the right and authority, and it shall be
their duty from time to time as it may appear necessary, to purchase
tools, teams, wagons, machinery, material and supplies by
and with the advice and consent of the members of said Court
and in accordance with the provisions of the General Laws of
the State of Texas regarding such purchases, and employ any
necessary men or teams, and to make on behalf of the County
all necessary contracts to carry out the purpose and intention
of the provisions of this Act, and may in its discretion provide
for the working of all County convicts upon the public roads of
said County and the amount allowed the said convicts for working
said roads shall be fifty cents (50c) per day.
SEC. 5. It is hereby made the duty of said Road Supervisors
to inform themselves of the condition of the public roads in their
respective Precincts, and to drag and maintain said roads in
their respective Precints.
SEC. 6. Every person liable for road duty under the General
Laws of the State of Texas relating to public roads, and residing
in Austin County, Texas, shall pay to the Tax Collector of
said Austin County, a road tax of Five ($5.00) Dollars on or
before January 31st for the year prior thereto, and the Tax
