Clerk of the Commissioners' Court
Similarly, the Constitution provides that the county clerk
preserve all books, papers, records, minutes and effects of the
Commissioners' Court, the administrative or policy-making body of
the county. It is made up of the county judge and the county commissioners
who are elected in each county for a term of four years.
The Court's basic powers are 1) to lay off the county into precincts;
2) to establish and control public ferries, bridges, and
roads; 3) to provide and maintain courthouses, jails, and all other
necessary public buildings; 4) to audit and settle all accounts
against the county and direct their payment; 5) to provide support
for paupers, idiots, and lunatics who can neither enter asylums nor
support themselves; and 6) to levy taxes [Gammel, VIII, 888-889].
The Commissioners' Court, however, has very little authority over
the other elective and constitutionally authorized county officials,
whose duties are prescribed by statute.
DISTRICT CLERK
According to the Constitution, the state is to be divided into
as many judicial districts as may be provided by law, with a
district judge for each district and with a district clerk elected
in each county. The jurisdiction of the district courts is defined
