,of said board of trustees are hereby empowered to appoint any
qualified person or persons to fill such vacancy or vacancies.
SEC. 5. The board of trustees of the school district as created
by this Act shall be a body politic and corporate in law, and as
such may contract and be contracted with, may sue and be sued,
may plead and be impleaded in any court of competent jurisdiction
in the State of Texas, and may receive any gift, grant, donation
or device made to or for the use and benefit of the public
free school in said school district.
SEC. 6. The title to all the properties vested in, belonging to
.and accrued to the heretofore existing Common School District
No. 5 of Jefferson County, Texas, and all properties held in trust
by any person or persons for the use and benefit of said heretofore
existing school district, are hereby divested out of the said
,Common School District No. 5 of Jefferson County, Texas, and
,out of any and all such persons holding the same or any part
thereof in trust, and all such properties and absolute title thereto
are hereby vested in said French Independent School District as
created by this Act and the board of trustees of said school district.
And, any and all public free school funds on hand belonging
to and accrued to the public free schools of said heretofore
existing school district shall be delivered over to the proper officers
and agents of the French Independent School District as
created by this Act for the use and benefit of the public free
schools in said school district as created by this Act.
SEC. 7. All bond and maintenance taxes heretofore voted,
authorized and levied in and for said heretofore existing school
district are hereby validated and continued in full force and
affect in said school district as created by this Act, and the same
shall continue in the amounts to be hereafter levied, assessed and
collected by the proper officers on all taxable property within
the boundaries of said school district as created by this Act, until
such time as said taxes may be increased, diminished or abolished
in the manner as provided by the General Laws of the State of
Texas applicable to independent school districts. And all bonds
heretofore authorized, issued and assumed for and on behalf of
said heretofore existing Common School District No. 5 of Jefferson
County, Texas, are hereby, in all things, validated.
SEC. 8. Nothing in this Act shall ever be construed to impair
.any bonds, contracts, obligations and debts had and made, assumed
and issued by and upon behalf of said heretofore existing
GCommon School District No. 5 of Jefferson County, Texas. And,
it is hereby expressly provided that any and all bonds, contracts,
obligations and indebtedness, and any and all accrued interest
thereon, constituting valid obligations of and upon said heretofore
existing Common School District No. 5 of Jefferson County,
Texas, shall be and are hereby declared to be valid and binding
obligations of and upon said French Independent School District
as created by this Act, and all such bonds, contracts, obligations
and indebtedness shall be enforceable from, paid off and dis,charged
