He was asked:
Mr. Tyner, how can you claim an attorney-client relationship until
you have first identified the client?
He declined to answer stating that he cold not disclose a communication made to
him by his client during the existence of the attorney-client relationship.
Counsel told him that: "by failing to establish the relationship which you are
claiming, you may well have extinguished any privilege that may have arisen therefrom."
He declined to discuss the R. V. Jobe transaction claiming the attorneyclient
relationship. He was told:
There is further testimony before this Committee, Mr.
Tyner, that Jobe is a fictitious person, whose real
identify is L. D. Murphy. If it should prove that there
is no such person as Jobe and you have claimed the
privilege of the lawyer-client relationship with a
fictitious person, do you realize the jeopardy in which
you have placed yourself?
He declined to answer the question.
