(1) Did you not know as a fact that at the time you purported
to act in this attorney-client relationship that R. V. Jobe
was an assumed name used by L. D. Murphy for the
purpose of receiving bribe payments in connection with
dereliction of duty by L. D. Murphy as a Railroad Commission
employee?
(2) Did you not know as a fact that the conveyance of a mineral
interest to J. W. Tyner, Trustee, in the Amtex-Elder,
Amtex-Russell and Amtex-Utzman Leases were in fact
bribes paid to L. D. Murphy in consideration of his
dereliction of duty as an employee of the Railroad
Commis s ion?
(3) Did you not know as a fact that the conveyance of a mineral
interest to J. W. Tyner, Trustee, in the Amtex-Barton Lease
was in trust for L. D. Murphy and that the consideration was
that Murphy would permit the kicking of a well on that lease,
and once drilled would permit it to produce oil in dereliction
of his duty as an employee of the Railroad Commission?
He declined to answer whether or not he knew Earl Sharp or whether Earl
Sharp was a client of his, or whether he had ever had any business transactions
with Earl Sharp.
He was asked by Counsel:
I do not believe Mr. Tyner that naming or identifying your client
constitutes an invasion of an attorney-client relationship. We
have not asked you to answer, over your objection, the nature
of the dealings or confidential coQmunications between yourself
and your client. We have merely asked you to state whether or
not L. D. Murphy is a client of yours. Would you please answer
that question yes or no?
He declined to answer claiming the attorney-client relatioiship and that his
truthful answer could incriminate him.-45
