the person so restrained, or his relatives or from any other person,
any money or valuable thing, or every person who by force,
threats, fraud, duress, or enticement takes, confines, kidnaps,
conceals, or entices away any other person for the purpose or
with the intent of taking or receiving, or demanding, or cxworting
from the person so restrained or kidnapped, or his relatives, or
from any other person, any money or valuable thing, is guilty
of a capital felony and upon conviction shall be punished by
death or confinement in the penitentiary for any term of years
not less than five; provided, however, that in all cases where
the person kidnapped, detained, or enticed away is returned by
the defendant without serious bodily injury having been inflicted,
the punishment shall be by confinement in the State Penitentiary
for any term of years not less than five.
SEC. 2. The aforesaid penalty applies in every case regardless
of whether the offense originated within or without the
State and the venue of the offense shall lie in the County where
the kidnapping occurred, or where the person was held or detained
or in any County through which the kidnapped person
was taken.
SEC. 2a. The fact that there is at this time no law which
punishes the act of kidnapping for extortion, ransom or robbery,
creates an imperative public necessity demanding the suspension
of the Constitutional Rule requiring bills to be read on three
several days, and said rule is hereby suspended, and this Act
shall take effect and be in force from and after its passage and
it is so enacted.
SEC. 3. This Article shall be known as Article 1177a, of the
penal code.

S. B. No. 16.] CHAPTER 13.
An Act to provide for the nomination of Directors of Water Improvement
Districts to serve under the provisions of Chapter 2, Title 128, of the
Revised Civil Statutes of Texas, 1925, and to repeal all laws in conflict
therewith; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That any person eligible to serve as a director of
Water Improvement Districts under the provision of Chapter 2,
Title 128 of the Revised Civil Statutes of Texas, 1925. may file
