STATEMENT OF FACTS IN MISDEAMEANOR CASE TO
ACCOMPANY TRANSCRIPT.
H. B. No. 5.] CHAPTER 11.
An Act amending Section 2 of Article 760, of the 1925 Code of Criminal
Procedure, of the State of Texas, so as to permit the Statement of
Facts in a misdemeanor case to accompany the Transcript instead of
being copied therein, and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That Section 2, of Article 760, of the 1925 Code of
Criminal Procedure of the State of Texas, be amended to hereafter
be as follows:
"Section 2. To accompany Transcript-The Statement of
Facts in felony or misdemeanor cases shall not be copied in The
Transcript of the Clerk, but when agreed to by the parties and
approved by the Judge, shall be filed in duplicate with the Clerk,
and the original sent up as a part of the record of the cause on
appeal; and like procedure shall be followed if the Statement of
Facts is prepared by the parties or by the Judge, on the failure
of the parties to agree."
SEC. 2. The fact that Section 2, of Article 760, of the 1925
Code of Criminal Procedure of the State of Texas now requires
the Statement of Facts to be written and then re-copied at the
expense of the defendant, in the appeal of a misdemeanor case,
creates an emergency and an imperative public necessity, requiring
that the constitutional rule, providing that bills be read on
three separate days, be suspended and the same is hereby suspended,
and it is so enacted.
