Springs caused by Saturday's tragedy
and the partisanship of the adherents of

sulted In the quiet formation of a mili

Berry and are now in the company's

report continued rains and tho water
rising. The people living In the bottom
lands nro tilled with apprehension of
another Hood. Many have not yet re-
dcovered from tho late delugeand the dis-
couraging outlook tends to Increase tho
uncomfortable feeling. With nine feet
of water now submerging the low dis-
tricts of the two cities It Is quite proba-
ble that the situation of allalrs among
the sufferers In Allegheny Is worse lr
possible than at any day since the Hood
abated and. numerous additional cases
of destitution are reported. Many of
tho victims In addition to having been
plundered by water were thrown out of
employment by work shops being devas-
tated and under any circumstances this
iact was aione productive or more or
more or less want among the poorer
classes. Over 3C00 people were supplied
with food yesterday an Increase over
any previous day.
Washington February 12. The Sec
retary of War is taking acttvo measures
looking to the Immediate relief of the
sufferers from the overflow of the Ohio
river and Its tributaries In accordance
with the act appropriating $300000 to
that purpose. Orders were Issued to
day for General Amos Iloaxwlth Assis
tant Commissary General stationed at
St. Louis to proceed at once to Cincin-
nati where he will havo general charge-
of the distribution of supplies. He will
establish his headquarters at Cincinnati

ceived for the purchase of supplies nnd
to charter a sufficient number of boats to

BILLY M'COY HIDES IN AMBUSCADE AND
SHOOTS AN OLD MAN.
Marshall the Victim Is Carried lo His Humble
Home And Then to the HoipiUI-. McCoy
scapes And Is Not Yet Captured.
A poor old mnn named Marshall a
carpenter In tho employ of the Lone
Star brewery was wending his way
homeward last evening near sundown
by tho river side and about midway be
tween tho brewery and his humble
home. The entire distance traversed
was not over 400 yards. It appears that
he had called 11111 McCoy who did the
shooting a thief and If the police re
cords have not made any mistake he
called McCoy by his right name. Mrs.
Coggshall who lives across from the box
tent of Marshall wns told this and re-
peated It to McCoy. He Instantly de-
termined to avenge himself on Marshall.
Marshall was n hard-working man 'a
widower with three children two girls
and a boy none of them very bright and
the oldest about 13 years and relied on
his dally labor to support them. A

tho shooting this morning at tho'new
.one Star brewery In course of erec
tion. Ho was directed to follow tho
trail of tho San Antonio river where It
meanders and flows placidly though
tortuously up to within a few feet of the
tent which Marshall occupied with his
motherless brood. After following tho
directions given by n party of ldlo men
who eat warming themselves In
tho blue smoke which colled up
from an Impromptu lire innde of
few wet logs ho at length
struck tho house of Mrs. Coggshall.
Here n girl of some 14 years approached
the door Inquired who was without and
opened It. Slio had nothing to say
only that Marshall was removed to tho
hospltaj at midnight at the advice of
Detectlvo Hughes who had been early
on the groundtook his notes and ascer
tained that his rough open tent was no
placo In which the sufferer could expect
relief or a fair chance for life tinder tho
circumstances. Marshall was shot
through the breast In the region of tho
heart and his condition at the hospital
though not altogether promising evinces
that he has some chances of llfo.
McCoy the villain who shot him on
this lovely spot Is a lowrufllan. His as-
sociates were always among tho lowest
of the white Mexican and colored ruf
fians who frequent this neighborhood
He lay In wait for his victim as ho
returned from his labor and tired three
shots though only one took effect. After
doing tho shooting ho escaped and not'
withstanding all the efforts of tho police
to capture him he has so far eluded his

assassm. It Is to be hoped that Marshall
will recover If only to be of some help

Clerk of Wells Fargo A Co.
Mr. Fred Fries who Is well known
here having tsen born and reared in San
Antonio Is unaccountably missing. Ho
has been In tho employ of Wells Fargo
& Co. for the past three years and lat-
terly In the capacity of money clerk
He Is a most model young man In de
portment and conduct and his tils
appearance Is onusing his relatives and
friends much anxiety. He was last seen
on the corner of Soledad and Commerce
streets on Monday night about 11 o'clock
and slnco then all traces of hlmhave been
completely wiped out. Mr. Nixon the
agent of tho Express company wultcd for
him allday yesterday very much put out
nnd nonplussed by his failure to arrive
and resume his accustomed work. Wait
ing until late last evening ho examined
the safe and found that all of Fries' ac
count were correct und the money and
valuables for which ho should be held
responsible were found correct and ac-
countedor. There was not a penny
missing. Tho result showed that the
charge confided to him was not mis
placed and Is In keeping with his well
known character for probity upright-
ness and loyal devotion to duty. Mr.
Nixon the agent wns his warm friend
and has always kept his eye on young
Fries us ono of tho most promising
young men ho had ever met for promo
tion with the company.
It Is feared that ho has met with foul'
play. Thieves orgarroterswho appear to
bo In some force here and who knowing
the position of .trust which young Fries
occupied with the Express cpmpany
may have entrapped him Into some prl
vat o place and robbed or murdered him
expecting great booty to bo found on his
person. His brothers Walter George

pearance but so fur unfortunately no

lost his mother at an early nge and Mrs.
McKay his only sister supplied the

was particularly attached to Fred. Ho

all bis private affairs as well as contldcd

fact most devoutly attached to her.

The question of planting trees and
beautifying the public park is assuming
very gratifying proportions. A meeting

evening another meeting was held In tho

which elected for Its chairman Alder-

rided Puritans In New England In 1021
nnd has always been defended upon tho
ground that education renders ono a bet-
ter and moro useful citizen. The man
with no child has to pay the school tax.
the man with ono child has to pay it
and so has the man with a dozen
children but they pay nn ad valorem
tax on their property and tho advan-
tages of the schools aro not equal to all
as Communism demands. Tho man
without children gets no bcncllt from
them the father of one child gets only
one-twelfth of the benefit derived from
them by tho father of 12 children. Com-
munism means equal division not in
equality or disparity.
Our constitution secures freedom of
speech but It howhero exonerates men
from the abtiso of this privilege. More-
over it secures It to American citizens
of birth or adoption and not to cranks
who flock to our shores from foreign na-
tions to escape the punishment merited
by them. Freedom of speech does not
mean licentiousness obscenity nor im-
morality. No man lias a right to urge
men to commit arson theft forgery and
murder by telling them such acts are
commendable and the statutes against
tbem aro barbarous and cruel. Neither
has a man n right to urge tbo depriving
men of their property In order to parcel
It out. Freedom of speech does not
screen these gross assaults on the publlo
welfare.
As to giving too much notlco to the
doings and sayings of the Communists
that Is an opinion but It la not an argu
ment and It Is simply bosh. The same
cry was eohoed and re-echoed when
fenco cutting begun. The Tocsin a-

Death of Mr. Frank L. Paschal an Historic
Landmark of the State
Mr. Frank L. Paschal died early this
morning. Tho mere mention of this fact
will bring mourning to his relatives in
this olty and State sadness to his many
friends nnd will awaken reminiscences
of the early days of historic. Texas. Tho
deceased camo hero In 1830 and figured
prominently In the stirring days of our
State long before tho American war with
Mexico. Since that oventful period bis
life In lloxar oounty has been one of re-
markable usefulness and progresslve-
ness. He leaves behind him children
bearing his own honored numo and who
have rcfleotei back upon their father
many of his own virtues ne will be
burled to-morrow morning at 11 o'clock
from the First Presbyterian church.
