Congressitembledyntai if any sheriff shall fail
to return an execution within the time prescribed
by law or shall neglect to pay money recovered
upon an execution to the counsel of record upon
an execution there shall be rendered against Mich
sheriff a judgment for the account due upon the
execution with ten per cent darmges and also ten
per cent interest per month until the whole amount
be paid; provided that the party moving fur such
judgment shall have given to the sheriff at least
three days notice before the motion made which
judgment may be rendered before any court of re-
cord in the county where such execution was is
sued.
Sec. 2. Be it further enacted Thit in any cast
where the sheriff is a party to tne suit all processes
shall be executed by the constable of the township
where the court is held in cases where there is no
4$s. coroner in the county or if he be absent from the
- "seat of justice of the county at the time the pro-
oess'is obtained and in such case the constable
shall have jurisdiction co-extensive with the county.

THE Proprietors take pride in offering to'PnbTic
Notice the Town of Liverpool situated on the
West bmk of Chocolate Bayou about 20 miles by
i uler abovr its mouth and about 45 from the city of
Galveston and distant 16 miles in a direct course
from the River Brazos by a route unsurpassed for
the construction of a rail-way; it is level for'the
whole distance being uninterrupted by any undula-
tions perceptible to the eye arid more! than 3-4 of
it being overhard prairie"and each extremity abound
ing in the best ;md most durable kinds of timber.
The navigntion of the Bivou is unobstructed by
snags or overhanging trees and is of ample width
add affords on the bar at its mouth as will appear by
Col. Harcourfs suney made by order of the 'Go-
vernment of the Rcpubl'c of Texas an average
depth at ordinary low tide of four ieet water and
very soft mud bottom.
That there will he a large importing & exporting
town near the East end ofGulvealon Island no longer
seems to be doubted; that this town must derive its
chief hopes of permanent wealth and consequence
from drawing to itself the rich productions of tho
valley of the Brazos is incontrovertible.' It' is no
less certain that iu order to arrive at this end a
cheap and safe channel of commercial intercommu-
nication must be opened between the two points.
A bare inspection of the map of Texas would go far
to satisfy the observer that the JRout-bn the
TOICH of Liverpool theflarger portioircr
which is already accomplished By the hand of Na-
ture leaving only 16 milescf land carriage possesses
advantages superior to any other yet offered to pub
lie attention. "
The locality of Liverpool haslong been considered
perfectly healthy and abounds with copious and de-
licious springs of water within the actual limits of
the Town. A steam boat will run weekly between
Liverpool and Galveston and a steam boat is sIm
building for that trade.
In addition to the advantages mentioned above
the town tract as well as a larce body of land ad
joining abounds in large pine cedar and white oak
tun lit r and a large saw ana grisi nun is now in ope-
ration within the limits of the town.
The town has b en hid off in a tract.of abont 740
acres of land fronting exceeding one mile on the
Bayou and the same distance on thg prairie and is
divided into thirty-two shares which are offered for
Sale on reasonable terms.
A survey of the Biyou and Chocolate'Bay has
lately been made by Mr. William It. Hunt who con
firms the report made by Col. Harcourt and reports
two good channels oue running to the Weal and
the other to the East end of Galveston.
Wm. T. Austin will hereafter re?ide permanently
in the town and will act as agent forthe proprietors
in disposing of lots -ind shares to those who may de-
sire to purclidst..

THE a(tcntion of the public is respcctfally called
to the examinationof the above town site.
It is a bnautiful high bluff known as 'Edwards" or
Davis1 Point situated on the west side of Galveston
Bay immediately at the commenceraedt of Red
bisli Bar entirely tree from inundation and pos
sessing superior advantages over any other locition
on the Bay in point nf hcillh and w.itor. A com-
pany has already been formed and nil the stock
taken arrangements are made for the erection of a
large tavern and warehouse and also for the build
ing of a wharf. An agent will be constantly on
the Point with a plan of the town to give any in-
formaiioii that may'be required relative to the title

TS situated on the west bank of the Colorado
- river just above the La Bahia crossing in the
county of Fayette a mile or two above La Grange
and within an hundred miles of Matagorda Bay.
It was formerly known by the nime of Elcctra.
fhis site was selected by Judge Evans several
years ago and those who have visited it think it
does credit in his judgment. The situation is emi-
uenilv i.eT.niful surpassed by few if any in the
Republic. A h 1 11 11" extends along the river for the.
dist mce of nearly a mile and above the highest
floods. The pr urie here comes quite to the river.
There is here good pnrc and never-failing spring
water. A chain of prairies extends along the west
bank of the Colorado river ibove this place to the
mountains equal in fertility to the alluvh n of the
Mississippi. On the south the country is fine to
the Bay of Mitagorda. The land west of tho town
on Buckncr's creek and head waters of ih i Navi-
dad and La Bacca rivers is of excellent quality.
The town is not only surrounded by fertile country
on all sides but h is also tho charms of romantic
.scenery. About two miles south ot Unlorado city
there is a hi'h range of beautiful hills running '
along the south side of Bucknejjs creek te the mar-
gin of the river. A foui4f!Tiwt3cs in this ridge
which is sufficiently elevateovvatcr a city on the
plain. There is niso a very high bluff on the east
side of the river a mile or two above whiili may
be seen from the town. There is abundance of
stone in Ihe vicinity for building purposes. On the y
east side of the river a few miles above the town.'
there is an abundance of Pine timber. The j!ne
hills in some places ire washed by the river. It is
scarcely necessary to speak of the river to those
who arc acquainted with Texas; there is no doubt
that steamboats could now-navJajtlAjhe river from
the raft to Colorado city. The purity aruTTranspa-
rency of its waters and its average depth render
it one of the most interesting rivers in Texas.
Taking into consideration the capacity of the river"
for navigation the extensive tract of fertile and
beautiful country by which it is surrounded the
excellency of its spring water the healthiness of
its situationand its cemrality it is apparent to the
superficial observer that Cohfrado Cttyis second
