Two Cherokee County Men Assessed
Five Years For Automobile Arson
Special to The Monitor
LeRoy Small and Erry Ben-
ton, Tuesday of this week were
convicted and assessed the
maximum five year sentence in
Second Judicial District Court
in Cherokee county. This case
arose out of a charge of burn-
ing personal property to col-
lect insurance (and carries a
maximum penalty of five years
imprisonment and a minimum
of two years. The jury was out
only ten minutes in arriving
at their verdict which carried
the maximum sentence. Repre-
senting the state was District
Attorney R. C. Musselwhite,
"who injected such a volume of
testimony against the defend-
ants that both plead guilty dur-
ing the coulrse of the trial.
It was shown during the
trial, and further corroborated
by the defendants themselves,
that they had first wrecked the
automobile and then later re-
turned to the scene of the
wreck and deliberately set fire
to the wreckage with the view
in mind of collecting the ad-
ditional benefits which would
naturally come to them by
reason of a fire insurance policy
carried by them jointly on the
vehicle.
