YOUR RIGHTS UNDER THE TEXAS
HOME SOLICITATION TRANSACTION ACT
In todays society we are often confronted
with sales tactics which pressure us to by buy
a variety of items. Because of good salesmanship
we end up buying the item then decide later that
we really didn't want it or that it doesn't work
properly. Often this is the case in door-to-door
sales, where a salesperson calls on you at your
home trying to sell a product or service such
as home improvements. The Texas Home Solicitation
Transaction Act is a law which protects your
rights as a buyer during this type of situation.
There are several points ab out this law that are
important to remember.
(1) The salesperson must advise you that you
have the right to cancel any sales agreement for
more than $25-00 within three business days after
the sale.
(2) You should be furnished a written notice
of cancellation which you can mail to the business
in order to cancel the sales agreement.
(3) You should be given a receipt and copy of
the sales contract.
(4) If you do cancel the sale, all payments
should be refunded and any trade-ins returned.
But the most important point to remember is that
this law only provides protection for your right to
cancel a door-to-door sale if the company is
legitimate to begin with. Never buy any product or
service sold on a door-to-door basis unless you
are completely certain that the company is legi-
timate and can be located; that the salesperson
represents the company, and that you need or want
the product in the first place. If you are sus-
picious about the company, there are at least two
ways to get information; one is by telephoning
the Better Business Bureau of Metropolitan Houston
and the other is to call the Consumer Fraud Dividsion
of the Harris County District Attorney's Office.

If they could not meet this requirement, the Texas Department of
Safety could hold the vehicle involved until a cash bond is posted. The
term "proof of financial responsibility" is defined to mean the proof of
ability to respond in damages for liability, on account of accidents,
occurring subsequent to the effective date of the proof and arising out of
the ownership, maintenance, or use of a motor vehicle, in the amount of
(1) $10,000 because of bodily injury to or death or one person in any one
accident (2) (subject to the $10,000 limitation for one person ) in the
amount of $20,000 because of bodily injury to or death of two or more
persons in any one accident; and (3) $5,000 because of injury to or
destruction of property of others in any one accident.
Now all this may seem somewhat complex and confusing, however; there
is one approach which is simple and provides a way of complying with the
requirements listed above and thus being relieved of the possible burden
of posting security after an accident; contact a competent and trusted
insurance agent and ask him about automobile liability insurance.
