election, in 1938, seven constables and seven justices of'the peace were
elected in Gregg County.28
The county clerk serves the county as recorder.29
The county commissioners court is the tax levy court of the county.30

It is also the board of tax equalization.1
Besides those already mentioned, county officers and boards in Gregg
County are: The tax assessor-collector 32 the county treasurer;3 the
county auditor;34 the county surveyor;35 the county board of school trustees,
composed of five members;36 the county board of school examiners,
composed of two members;37 the county school superintendent;38 the county
health officer;39 and the board of managers of the epounty hospital, the
Gregg Memorial Hospital.4
A county officer is so called because he eis limited in the exercise
of his official powers to the boundaries of the county, but when the
character of his office, rather than the territorial extent of his powers,
is considered, he is classed as a State officer, for his office is created
by State las and, within the county, , he performs functions for the
State.41 He is not, however, considered to be or ever referred to as an
officer of the State government; that designation is applied only to an
officer who immediately belongs to one of the three constituent branches
of the State government and whose powers are coextensive with the limits
of the State.42
