Election judges may assist a voter in marking his ballot, if he has
physical infirmities, or is over 60 years of age and unable to read and
write, but must not suggest "by word or sign or gesture, how such voter
shall vote."61
The voter's marked ballot is returned to the election judges, and
if they are satisfied from an inspection of the signature endorsed on it
that it is the official ballot furnished the voter,62 it is deposited in
the ballot box.63 One of the election officers then places the letter
"V"64 opposite the name of the voter on the list of qualified voters.65
This list, arranged alphabetically and by precincts, contains the names
of persons who have paid the poll tax or have been issued exemption certificates.
It is compiled annually in each county by the tax assessorcollector,
and furnished to the election officials together with the
blank ballots by the election supply board.66
The election judges must count the ballots and, within 72 hours
after the closing of the polls, must make a return of the election results
in their respective precincts, showing the number of votes cast
for each candidate and issue voted upon. The return is made in triplicate.
One copy is lodged with the county judge; another with the county
clerk; and the third is retained by the presiding judge of election.67
The election returns from all the precincts are tabulated by the commissioners
6ourt to determine the results of the election throughout the
county. Within 48 hours after the returns have been thus canvassed
by the court, the results of the election must be reported to the Secretary
of State by the county judge.69
The canvass of election results made by the commissioners court is
the county judge's authority for the issuance of certificates of election
to successful candidates for county and precinct offices.70 The
certificate of election is evidence of the holder's right of office unless
and until it is invalidated through election contest or judicial
proceedings.71
The election results from all the counties of the State are compiled
by officers of the State government to determine the results of
the election for State and National officers and for the adoption or
rejection of constitutional amendments.72
