Obituaries
ALFONSO G. "PONCHO" JIMENEZ
A graveside service for Alfonso G. "Poncho" Jimenez,
79, of Roby, was held at 2:30 p.m. on Saturday, Jan. 23,
2010, at Sweetwater Cemetery with
Father Michael Rodriguez offici-
ating. Burial followed under the
direction of McCoy Funeral Home.
A rosary was held at 7 p.m. on
Friday, Jan. 22, 2010, at McCoy
Funeral Home, recited by Pauline
Gauna and Connie Palacios.
Jimenez died Thursday, Jan. 21,
2010, at his home.
He was born Jan. 12, 1931, in
Acuna, Mexico. He married
Herlinda Chavez Oct. 20, 1959,
in Sweetwater. He was a retired
fence builder and had lived in
Sweetwater since 1974, moving to
Roby in 2006. He was a Catholic.
Survivors include his wife,
Herlinda Jimenez of Roby; sons,
Armando Jimenez and wife Sylvia of Del Rio, Miguel
Jimenez and wife Marisella of Midland, Baldemar
Jimenez of Sweetwater and Martin Jimenez and wife
Angelica of Robert Lee; daughters, Linda San Juan and
husband Guillermo of Merkel, Virginia Guerra and hus-
band Tony of Roby and Mary Jimenez and husband Jose
of Trent; brother, Luis Jimenez and wife Kika of Del Rio;
42 grandchildren; and 50 great-grandchildren.
He was preceded in death by two sons, Alfonso
Jimenez, Jr. and Luis Alfonso Jimenez; and a sister,
Estella Jimenez.
Pallbearers will be Miguel Jimenez, Martin Jimenez,
Tony Guerra, Jose Sanchez, Eliseo Limon, Michael
Jimenez, Baldemar Jimenez and Jesse Alacron.
FIDS member pleads no
contest to sexual assault

— A West Texas polygamist
sect member was sentenced
to seven years in prison after
pleading no contest to sexual
assault of a 16-year-old girl
Friday.
Michael Emack, 59, of
Eldorado, entered the plea in
district court to sexual assault
of a child, said court admin-
istrator Irene Devore. Under
Texas law, someone younger
than 17 cannot generally con-
sent to sex with an adult.
Emack had been set to go
to trial Monday. His attorney
did not immediately return a

Emack's plea marked the
third sexual assault of a child
conviction for a resident of the
Yearning for Zion Ranch in
Eldorado, said Jeny Strickland,
a spokesman for the Texas
attorney general's office. Nine
other suspects, including sect
leader Warren Jeffs, are await-
ing trial on charges including
sexual assault of a child and
bigamy, Strickland said.
The ranch is ran by the
Fundamentalist Church of
Jesus Christ of Latter Day
Saints. The FLDS believes
polygamy brings gloiy in heav-
en and is a breakaway sect
of the mainstream Mormon
church, the Church of Jesus
Christ of Latter-day Saints,
which officially renounced
polygamy more than a centuiy
ago.
Following an April 2008 raid
at the ranch, Texas authorities
removed more than 400 chil-
dren and placed them in foster
aire, alleging they were being
abused because of underage
marriages. Two mouths later,
state courts found the removals
unjustified in all but a handful
of cases and the children were
returned to their parents.
A prosecutor read a state-
ment in court Friday that in
August 2004, Emack "spiritu-
ally" married a 16-year-old girl,
who then got pregnant with
his child that October when
she still was 16. Prosecutors
said Emack already was legally
married in the state of Utah
and had two other "spiritual
marriages" as well.
Strickland said a bigamy
charge against Emack is pend-
ing.
FLDS spokesman Willie
Jessop said Emack made the
plea so he could file an appeal.
Jessopsaid Emack did not want
to be tried by State District
Judge Barbara Walther, who
signed the order to remove the
children in 2008.
A message left for Walther
was not immediately returned
Friday.
"He didn't feel that he would
get a fair trial so he made a no
contest plea to move his case
into what he believed would
be a neutral court, the court of
appeals," Jessop said.
"We all veiy strongly believe
the state of Texas acted in veiy
bad faith," Jessop said. "What
the state did was selective
prosecution and they've used
the format of a biased court to
indict him."
Perry: exas gun
rights approach
makes state safer

AUSTIN, Texas (AP) — Gov. Rick Perry said Friday
that Texans should not be subject to more government
intervention and security measures after a gunman
opened fire at an entry to the Texas Capitol and that
the state's "enlightened" approach to gun rights helps to
keep citizens safe.
"In Texas, criminals have to think twice before they
draw a gun because there's a good chance they're going
to be outnumbered," Perry said, as he accepted the cam-
paign endorsement of the Texas State Rifle Association
and the National Rifle Association. "The fact of the mat-
ter is, that keeps us all safer."
The endorsement for Perry's re-election campaign
came a day after a man who fired several shots outside
the Texas Capitol was tackled by police while trying to
reload his handgun, according to court records. Fausto
Cardenas, who Perry said does not hold a concealed
handgun license, remained in Travis County jail Friday
on a felony charge of deadly conduct. Bond is set at
$250,000.
Perry was not in his Capitol office at the time of the
shooting.
Perry suggested he would not support placing metal
detectors at Capitol entry points.
"I'm always up for looking at new ways to protect our
citizens, but the last thing I want is the Texas Capitol to
turn into DFW airport," he said when asked about metal
detectors.
He praised the NRA for "establishing and maintaining
sensible regulations for gun ownership."
Perry, who said he is registered to carry a concealed
handgun, is facing a tough re-election challenge from
U.S. Sen. Kay Bailey Hutchison in the March 2 pri-
mary.
The NRA also commended Hutchison for her support
of gun rights.
"It is the policy of the National Rifle Association to
always endorse the incumbent unless something has
happened that is so egregious that you are not going
to do that," said NRA board member Susan Howard-
Chrane.
County Commissioners
to meet Monday
The Nolan County Commissioners' Court of will
have a regular meeting at 9 a.m. on Monday, January
25, 2010, in the Nolan County Courthouse at which
time the following subjects will be discussed:
1. Approve minute of Jan. 11, 2010 meeting.
2. Consider approval of the audit for budget year
9-30-08 through 9-30-09 presented by Lori Herwick
with Davis Kinard and Co. P.C.
3. Consider approval of revisions to the employee
policy handbook.
4. Consider approval to purchase mobile radios for
county volunteer fire departments to be reimbursed
by FY09 Homeland Security Grant.
5. Consider approval to hire a replacement for the
veteran service officer position.
6. Consider approval to allow the Sweetwater
Jaycees to use the property west of the SHS baseball
field in order to host the Matt Armstrong Carnival
March 10 through March 14, 2010.
7. Consider approval to put a burn ban in place for
Nolan County.
8. Receive reports from department heads.
9. Pay claims and line item adjustments, requested
by the county auditor.

site, when Carpenter is able to be at the museum.
