NOTICE OF HEARING
NOTICE IS HEREBY GIVEN to
the public and to all interested per-
sons that under the legal authority
and jurisdiction of Title 3, Oil and
Gas, Subtitles A, B, and C of the
Texas Natural Resources Code,
Chapters 26, 27 and 29 of the Texas
Water Code, and TEX, GOVT
CODE ANN. art. §§ 2001 et seq.
(2003), the RAILROAD COMM-
ISSION OF TEXAS will hold a hear-
ing on November 5, 2003, at 9:00
a.m. at the William B. Travis State
Office Building, 1701 N. Congress
Avenue, Austin, Texas. This hearing
will be conducted in conformity
with the TEX. GOVT CODE ANN
Art. §§ 2001 et seq. (2003). For
room assignment, on the date of the
hearing please check the bulletin
board in the Ist Floor lobby. Persons
planning to attend this hearing are
urged to contact the applicant (see
service list) immediately prior to the
hearing date to be sure that the
hearing will proceed on the sched-
uled date.
The Commission will con-
sider the application of Crest
Resources, Inc. for a spacing ex-
ception permit under the provi-
sions of 16 Texas Administrative
Code §3.37 (Railroad Commis-
sion Statewide Rule 37) and a
density exception permit under
the provisions of 16 Texas Ad-
ministrative Code §3.38 (Rail-
road Commission Statewide
Rule 38) to Drill Well No. 3138,
Mahler Lease, 640 Acres, Sec-
tion 138, Block 42, H&TCRR
Co./A. Studer Survey, A-924,
Parsell (Morrow, Upper), Parsell
(Morrow, Lower), Parsell, South
(Morrow Upper), Canadian, NW.
(Morrow, Lo.) Parsell, SE. (Doug-
las) and Wildcat Fields, Hemphill
County, Being 10 miles northwest
from Canadian, Texas.
The location of this well is as
follows: 1325' from the north
line and 825' from the west line
of lease and survey.
This well is to be completed
at an approximate depth of
12,500 feet.

ceeding and recorded with Docket
Services, Office of General Counsel,
Railroad Commission of Texas.
PURSUANT TO SAID HEARING,
the Commission will enter such rules,
regulations, and orders as in its judg
ment the evidence presented may
justify, including placement of the
proposed well at different location
from that requested by applicant,
and the establishment of the amount
of acreage on the applicant's tract
that can reasonably be considered
to be productive of hydrocarbons
for the purpose of assigning an
allowable.
ANY REQUEST FOR POST-
PON E-MENT of this hearing must
be received no later than five (5)
working days prior to the scheduled
date shown above. Copies of such
request must be forwarded to all
parties shown on the service list.

at least five (5) working days in ad-

FOR THE AUTHORIZATION
TO ISSUE
GENERAL OBLIGATION BONDS
AND LEVYING OF A TAX IN
PAYMENT THERE- FORE;
PROVIDING FOR THE CONDUCT
OF SAID ELECT- ION; AND
MAKING OTHER PR0VIS- IONS
RELATED THERETO
WHEREAS, the Board of Direc-
tors (the "Board") of Hemphill
County Hospital District (the "Dis-
trict") deems it necessary and advis-
able to call an election in accordance
with Chapter 424, 66th Legislature
Regular Session (1979) as amended
by Chapter 488, 78th Legislature
Regular Session (2003) (as amended
the "Act") and, the election laws of
the State of Texas; and
WHEREAS, in accordance with
Section 3.005 of the Texas Election
Code, this Order is adopted not
later than the 45th day before the
date set forth for the election as de-
scribed herein.
NOW, THEREFORE, BE IT
ORDERED BY THE BOARD OF
DIRECTORS OF THE HEMPHILL
COUNTY HOSPITAL DISTRICT
THAT:
Section I: An election shall be
held within the boundaries of the
District on the 4th day of Novem-
ber, 2003, for the purpose of sub-
mitting to the qualified electors
residing therein the following pro
-position:
PROPOSITION
Shall the Board of Directors
of the Hemphill County Hospital
District be authorized to issue
general obligation bonds of the
Hemphill County Hospital Dis-
trict in the principal amount of
$4,000,000 to provide funds for
the purchase, construction, ac-
quisition repair, and renovation
of buildings and improvements,
and equipping them for an as-
sisted living facility, and includ-
ing land therefor, such bonds to
be issued in one or more series
or issues, to mature serially or
otherwise not more than forty
(40) years from the date of issu-
ance, and to be issued and sold
at any price or prices and bear
interest at any rate or rates (not
to exceed the maximum rate al-
lowed by law) that shall be de-
termined within the discretion
of the Board of Directors of the
Hemphill County Hospital Dis-
trict; and to levy annually an ad
valorem tax on all taxable prop-
erty within the Hemphill Hospi-
tal District, in an amount
sufficient to pay the annual in-
terest on said general obligation
bonds and to provide a sinking
fund to redeem the bonds at ma-
turity for said general obligation
bonds not to exceed $0.75 on
each $100.00 valuation of tax-
able property in any one year?
Section 2: Paper ballots shall be
used in said election and said official
ballots shall be prepared in accor-
dance with the Texas Election Code,
so as to permit qualified electors to
vote "FOR" or "AGAINST" the
aforesaid proposition which shall be
set forth in substantially the following
form:
PROPOSITION
The issuance of $4,000,000 of
general obligation bonds for con-
structing and equipping an assisted
living facility and levying of tax in
payment thereof.
The word "FOR" and beneath it
the word "AGAINST" shall be made
to appear below the proposition and
on the left of the words "FOR" and
"AGAINST" each elector shall place
and "X" in the square beside the
statement indicating the way he or
she wishes to vote.
Section 3: For purposes of con-
ducting the election, the District has
one (I) precinct, Precinct No. I, and
the polling place for such Precinct
No. I shall be the foyer of the Cana-
dian High School gymnasium, 621
South Fifth Street, Canadian, Texas
79014. The Presiding Judge shall be
Mary Jo Leonard and the Alternate
Presiding Judge shall be Janice Schafer
(each of whom meets the general eli-
gibility requirements of Section
32.051, Texas Election Code).
Early Voting ballots shall be
counted by a canvassing board and
the following person is appointed to
said board to wit: Mary Jo Leonard
will serve as Presiding Judge.
That each of the Presiding Judges
herein appointed shall appoint not
less than two (2) nor more than
seven (7) clerks to serve and assist in
holding said election provided that if
the Presiding Judge of the polling
place actually serves, the alternate
Presiding Judge shall be one of the
clerks. To the extent required by
the Texas Election Code, as
amended, or other applicable law,
the appointment of these clerks
must include a person fluent in the
Spanish language to serve as a clerk
to render oral aid in the Spanish lan-
guage to any voter desiring such aid
at the polls on election day.
On election day, except as pro-
vided in Section 41.032 Texas Elec-
tion Code, the polls shall be open
from 7:00 a.m. to 7:00 p.m.
Section 4: That early voting for
this election shall be conducted by
personal appearance and by mail or
other lawful means. There shall be
one early voting place to wit: The
Business Office at Hemphill County
Hospital, 1020 South Fourth Street,
Canadian, Texas 79014, with Mary
Jo Leonard as presiding judge. In ac-
cordance with Section 85.001,
Texas Election Code, the hours
hereby established for early voting
by personal appearance shall be on
the seventeenth day before Novem-
ber 4, 2003 through the fourth day
before November 4, 2003, from
8:00 a.m. to 5:00 p.m. (which are
the hours that the District's main
business office is regularly open for
business) on each day except Satur-
days, Sundays and official state holi-
days. Early voting will start October
18, 2003, and close for legal holidays
(None) and ballots may be mailed to
the above address. The last day for
early voting appearance is October
31, 2003.
Section 5: All qualified electors re-
siding within the boundaries of the
District shall be permitted to vote at
said election. The holding and con-
duct of said election shall be in ac-
cordance with the Texas Election
Code, and applicable general laws
and laws regarding county elections
and the act. In accordance with the
Act and Section 4.003 Texas Elec-
tion Code, notice of this election
shall be given to all qualified electors
in the Hemphill County Hospital
District in the following manner:
A notice composed of the words
"TO ALL QUALIFIED ELECTORS
OF THE HEMPHILL COUNTY
HOSPITAL DISTRICT - NOTICE
OF ELECTION AUTHORIZING
ISSUANCE OF BONDS AND
LEVYING OF TAX THEREFOR"
followed by, a copy of this Order
shall be posted not later than the
21 st day before the election day at a
public place in each election pre-
cinct with the Hemphill County
Hospital District and on the bulletin
board used for posting notices of
Board's meetings and published in a
newspaper of general circulation in
the District and meeting the re-
quirements of Section 4.003(a)(1)
(A) or (B) Texas Election Code once
a week for each of two consecutive
weeks, the first publication to be not
less than thirty (30) days before the
date of the election.
Section 6: In compliance with
Chapter 272 of the Texas Election
Code, all election materials will be
printed in English and Spanish, in-
cluding election materials used for
early voting.
Section 7: It is the intent of this
Board that the election called
hereby and the conduct thereof and
the other provisions relating thereto
comply with the election laws of the
State of Texas and the Act.
Section 8: That the Secretary of
the Board of Directors hereby ap-
point and the Board of Directors ap-
proves the appointment of Janet
Gray as the Secretary's agent, to
perform the duties for this bond
election as provided by Section
31.123, as amended, Texas Election
Code and for the purposes of main-
taining an office open for election
duties, which office shall be open no
fewer than three hours per day dur-
ing regular office hours, on regular
business days beginning three days
from the date of this Order and con-
tinuing until no less than 40 days af-
ter the date of said election. In
addition, the Board of Directors es-
tablishes the rate of pay for judges
$6.25 per hour and clerks to be
$6.00 per hour as established in the
Texas Election Code. The Presiding
judge or Alternate Presiding Judge
shall be compensated an additional
$25.00, provided that such payment
does not exceed that permitted by
law.
Section 9: If for any reason any
section, paragraph, subdivision, clause,
phrase, word, or provision of this Or-
der, or the application thereof, shall be
held invalid or unconstitutional by final
judgment of a court of competent ju-
risdiction it shall not affect any other
section, paragraph, subdivision, clause,
phrase, word, or provision of this Or-
der, or the application thereof to
other circumstances, for it is the defi-
nite intent of the Board of Directors
that every section, paragraph, subdivi-
sion, clause, phrase, word, or provi-
sion hereof be given full force and
effect for its purpose and the Board of
Directors declares that this Order
would have been enacted without
such invalid provision.
