why, for the information of the court, that it may take further
action.
SEC. 9. No person shall be compelled to serve as road overseer
who is lawfully exempt from road service; nor shall any
person be compelled to serve for two consecutive years.
SEC. 10.
If it so happens that a person who is lawfully
exempt from road duty is appointed as road overseer by the
commissioners' court, and who is unwilling to serve in that
capacity, he shall within ten days after receiving notice, notify
the county clerk of his non-acceptance and the reason therefor,
who shall bring it to the attention of the court at the next meeting,
when action shall be had thereupon. If notice of nonacceptance
is not given within ten days by such party, then he
shall be considered as accepting the appointment and shall be
held responsible to the court for performance of the duty required
by law.
SEC. 11. A copy of the law regulating the duties of road
overseer shall be printed on the back of each road commission
and also the law relating to exemption.
SEC. 12. It shall be the duty of the commissioners' court to
have posted in some convenient place about the court house at
all times, a list of all the road precincts and road overseers in
the county, that it may be easy to locate any road overseer who
is negligent in the discharge of his public duty.
SEC. 13. The commissioners' court of Upshur County is authorized
and empowered to employ a competent civil engineer
at such times and for such periods as the needs of the service
may require and the road funds will justify, to scientifically
plan and construct any road or bridge needing special skill in
its construction.
SEC. 14. All male persons residing in Upshur County, not
exempt from road duty by General Road Law of Texas, may be
required to work upon the roads for eight days of eight. hours
each, exclusive of the time of going to and returning from work
and exclusive of the time consumed in the lay off at noon.
SEC. 15. All persons who live in incorporated towns and
who pay as much as four dollars street tax shall be exempt from
the provisions of this Act. Any person who shall pay to the
county treasurer on or before the first of February the sum of
four dollars and who shall take a receipt therefor, showing that
he has paid for exemption from road duty for the current year,
and showing to which road precinct he belongs, which receipt
he shall deliver to his road commissioner or supervisor, who
shall then have his payment credited to the special road fund
of his precinct, for the current year, to be used for the maintenance
of the roads of his precinct. Any person who has failed
to pay four dollars on or before the first day of February of
each year for road exemption, and who is lawfully warned by
his overseer, may be allowed exemption from the service by
paying to his overseer one dollar in advance for each day he is
warned to serve, taking the road overseer's receipt therefor
