lating the law prohibiting tho sale of
intoxicating liquors on days c>f elcc
tion, was decided in|the county court
by the acquittal of the defendant by
the jury. No endeavor was made to
deny the sale of liquor on the 6th of
September last, but the defense held
that the election, while • to all
appearances a legal one, Was
deficient in that Messrs. Leoper and
Scott, manage off «lection in the
First and Pourth Wards respectively,
Were not served wHh a writ from bis
honor, the mayor, authorizing them
to hold the election as the charter and
ordinances demand. The defense held
that the day of election was not in
keeping with the law in tho
premisos, which any that in
the first election of trustees there
shall be; six elected, threo of
them to hold four years, and
the other throe for two years in order
to establish alternate elections and
that all elections shall bo two years
apart. The defense introduced reo
ord to show that tho first election for
trustees was held o« July 30th and
tho ballot declared on Aug. 2nd, but
that the election day upon which the
defendant is charged with having vio
lated the law came upon theCth day
of September which would naturally
show that it was over a month
too lato, to be in conformity with
the law on tho subject. These and
several other matters tending to show
irregularities in the election were ar
gued to some extent before tho court
and the jury, who.returned a verdict
of not guilty. Tho defense claim that
tho failure to notify by proper writ
tho two managers of election mado it
« parallel case with the Hunt county
local option test, and that inasmuch
as the election was not iu strict con-
formity with tho law no oftenso could
have been committed.
