drunk and armed with a six-shoot
er. His plea was insanity and
judging from tho lightness of his
sentenco this plea must havo had
great weight with the jury. If ho
was insane he should bavo been
sent to the lunatic asylum for life
or if ho was not insane be ought
to havo been hung. Tho plea of
insanity has been used so often as
to bo brought into contempt and
is commonly spokes ot as tho "in-
sanity dodge" and tho word
"dodgo" as nsod in this connection
is very significant. It is usual to
blamo the law for tho non-punishment
of criminals especially mur-
derers. Upon closo investigation
it will bo found that tho law itself
is not near so murh to biamo as
are the average juries empaneled
in criminal cases. With tho ex-
ception of tho caso with which con-
tinuances and changes of venue aro
obtained thero is littlo wrong with
tho law. It was popularly sup-
posed that tho law passed by the
last legislature would put a stop
to tho continuances granted from
term to term until tho witnesses
were all dead or had moved away
but up to this timo ifthoro has
been any improvement in this res-
pect it has not been made apparont.
In the matter of an improvement
in the "regulation" jury it is not
possible to determino at this timo
whether or not thoro has been any
improvement. Skillful criminal
lawyers seem fully equal to the
task of circumvonting tbo laws as
fast as tho legislature passes them.
It is to all appearances much
easier to pick flaws in tho law
than it is to enforce it. The sym-
pathy of tho public and of tho ju
ries is too much in favor of tbo
living man whilo there is none for
tho murdered man bis family or
friends. It is true that sympathy
does a dead man no good but tbo
manner of his "deadening" if tho
word is admissablo should have
its weight with the jury. The ob
ject of tbo law is to punish the
wrong-doer and to deter othors
from doing wrong. All laws to be
efficacious should be prompt and
certain in their action. For too
many men aro restrained from
wrong-doing by foar of tho law and
not by any moral sense.
