California lawyer who had served as the first chief justice of that state
and had later acquired considerable wealth, mainly through real es-
tate investments. More directly to the point, in 1878 he had founded
Hastings College of the Law, which he endowed with a donation of
$100,OOO.3
The Department of Jurisprudence, Judge Hastings advised, "should
consist of a faculty of two or three professors, including a Chair of
Comparative Jurisprudence and a Professor of Common and Roman
Civil Law." The former would be an "omnium gatherum"; the latter,
it seems, was to provide instruction in the common and civil law
which was to follow the students in their daily studies. A third faculty
position, a Chair of Ethics, was mentioned but not recommended in
view of "much trouble" on that subject at Hastings College.4
It will be seen that the advice of Judge Hastings was followed up to
a point, but not in its entirety. This should not be overly surprising,
