PIONEER HISTORY
First Term of Kerr
County District Court,
September 10th, 1856
The first term, of District Court
held in Kerr County was on the date
September 10, 1856, Hon. Thomas J.
Devine, presiding-; Prank H. Eg-an,
district attorney, S. B. Rees, district
clerk, P. M. Nelson, deputy district
clerk, and W. D. C. Bumey, sheriff.
The court was set for Monday, Sep-
tember 8, but no judge was present
and the court was adjourned by the
sheriff to Tuesday and still no dis-
trict judge. On Wednesday, the 10th,
however, Judg'e Devine was present
and court convened in the old log-
court house in Kerrville.
The jury empaneled for the term
was as follows, 36 names having-
been drafted by the clerks and jus-
tices of the peace.

ray, George N. Wechot, William Ben-

According to the record James M.
Starkey was appointed as foreman
by Judge Devine and the jury retir-
ed for their deliberations, with G. P.
Philips as special bailiff.
First County Clerk
this first term of court was $143.50.
In the case of State of Texas vs.
William Powler, the costs of the trial
were assessed against him in addi-
tion to the penitentiary imprison-
ment.
G. P. Philips received $4.50 for at-
tendance on the District Court as
bailiff. Court adjourned to meet in
February, 1857.

Governor Elisha M. Pease
Elisha M. Pease was born in Con-
necticut in 1812, and came to Texas
in 1835. After holding minor offices
in the State for years he was elected
Governor of the State of Texas in
1853. He was re-elected in 1855, and
was Goernor when the act creating
Kerr County was passed by the Leg-
islature, and approved that act by
his official signature January 25,
1856.
Pease is classed as one of the
ablest Governors of the State and

An x indictment was returned
against William Fowler for stealing
a mule, and upon trial next day he
was sentenced at one year at hard
labor in the State penitentiary at
Huntsville. Petit jurors listed to be
paid for service were:

Pish, Newton Price, Volney Ridley,

A. suit for a divorce styled J. S.
Brown vs. Margaret Brown. The
diorce was not granted, but the
plaintiff moved for a new trial which
was granted.
The jurors received pay for vary-
ing- periods of service, from two to
five days at $1.50 per day. The
total expenditure for jury service at

placed the stamp of his ability upon
man of the policies of the day. In
his first message to the Legislature,
re recommended, as of the utmost
importance, that suitable and per-
manent provision be made for the
support of public schools, and for
the establishment of the State Uni-
versity. He also advised the Legis-
lature to make provision for the es-
tablishment of asylums for lunatics,
for orphans, for the education of the
blind and the deaf and dumb. And,
except for the orpliant asylum, all
went into effect during his tenure
of office, says Thrall’s History of
Texas.
John Henry Brown's History of
Texas says of Pease:
"He was one of the ablest and
purest Governors Texas has ever
had. His messages to the Legis-
lature are model state papers,
not only on account of the
knowledge of the Constitution
and needs of the country and the
principles of civil government
which they display, but for the
wisdom of the recommendations
that they contain, and the ele-
gance and perspicuity of their
diction.”
As a lawyer, a legislator and ex-
ecutive, Pease was one of the fore-
most in the State. He died August.
26, 1883, and his remains are buried
in the cemetery at Austin.
