February 1003 defendants contracted
with plaintiff to secure and buy fpr
them about 1800 acres of land in Ma-
rion County from W S Terry Plain-
tiff alleges that in compliance with said
contract he obtained an option on said
land for defendants and thatthereafter
said land was duly transfered and con-
veyed by W S Terry to Defendnntsfor
675000 all of which was paid to W 8
Terrry except 75000 which they
agreed to pay plaintiff That said
plaintiff has often demanded payment
that defendants have refused to pay

Citation once in each week for four suc-
cessive weeks previous to the return
day hereof in some newspaper publish-
ed therein but if not then in any news-
paper published in the 8th Jubicial Dis-
trict but if there be no newspaper pub-
lished in said Judicial District then in
a newspaper published in the nearest
District to said 5th Judicial District to
appear nt the next regular term of the
District Court of Marion County to be-
holden at the Court House thereof in
Jefferson on the 4th Monday in Dec-
ember A D 1904 the same being the 26th
day of December A D 1904 then and
