The plaintiff's motion to quis.li was on the
jrround thst the same wa irregolar and in-ulE-rient
and that so much d1 said return as relates
to i negro man named Philip Lansing was su-
perfluous and no legal return and the whole or
the said return was illegal invalid and insuffi-
cient nnd only tended to emliarrass the plaintiff's
execution and for such amendments and rclier
as the miure or their case might require.
The first question made i' whether n district
Tourt has the (Kjwer to quash a return or the
lilt-riff?
Of this there can be no doubt in proper cases
and we have so decided in effect in the ca-e of
Scoll and Hose r. Allen 1 Texas reports 503.
For instance where the levy and returns nude
are not in accordance with 1 iw thv may be
splashed or where facts are stated which shows
there was no levy in Tact the return an) be vaca-
ted and set aside.
The next que-tion is whether there was error
in thejodgmentor the court quashing the re-
turn i this cae ?
It is very dear that there was no error in
quishing all tint p irt or the return in which Ihe
acts and sayings of the sheriff and others rcli-
live to the negro man l'hilipwere set forth. He
bad in fact made no levy upon the negro. He
had not at any time bad posession of the pro-
perty. He received only the name not the body
orthe alive from the defend mts and upon that
t. .a -! trtitt In .lnnmlii HP4 his lew.

tlie nrooMi 10 S. aad M. 35 14 Wend I2i
The whole of the statement in rcl ition to the
negro is superfluous. It is not the return or nny
act which waa in conformity with the exigence
of the writ aud should h ive been Mrieken out !
and quashed as impertinent surpinage.
But the question in relation to the vacating
and annulinje the latter portion of the writ is or
a more grave character.
lliia eliown that the land had been levied up-
on as the property ofne of the defendant' aud
after they had refused to point out any j roper-
y for levy. The sheriff also cerliryiop tint l-
aid not know of nny personal properly which lie-
longed tu the defendants. It is coiuendedihrt
this levy was illegal because it made n dona-
tion oT property by the plaintiff's counsel who
bad nn right to make such definition.
The statute or l&U in relation to executions
in iu fourth section digest urt. 13J7 declares
that the defendant his azcut or attorney in all
-- . .
cases shall have the right to designate thts "n-
lerty to be levied on provided said property
'be in Ibe county where judgment sliall '
been rendered -or to which execution Biny

-shall fail er rrfo'e to designate the siioe it be-
ing his pnap'rty then the levy shall bo mide in
the fullowinK manner: Erst on personal or mova-
ble property then on uncultivated lands then on
slaves aud lastly on the improved lands or home-
stead of the defend int.
It appear from the staluethat the defendant
tuts the right in all cases to deMnate property
for lew but should he Tail or rtnise to exercise
this privilege tho sheriff may proceed to levy
in the order precribed by tlie law. Ibe plnin-
tiff baa no right in any case where the property
is to lie sold without appraisement to insist
jpon making a designation. 1 be slieriff i not
