The opinion of the Clurt was delivered by
Hemphill C. J.
The pention albircs that one Mary Noble
now Mary Nash wile of Cooper B. Nash was
in 1840 "indebted to Jonas Harvey in the
sum of seven hundred and nineteen dollars
and that in consideration thereof she executed
her promissory note whereof she promised to
pay to the ejid Jonas Harvey or bearer lite
said sum ol 3719 and that by means thereof
die said Mary Noble now Mary Nash mid
her husband became liable to pay the said
Jonas Harvey or bearer the said sum of
.money according to the tenor and clfcct of
the said note. Gut that the said Mary and
Cooper disregarding their promises have not
paid the said sum ol money to the said Jonas
Harvey or to Haily George the bearer of
the said note but hau neglected lo pay the
same to the damage ol the said Daily George.
The petitioner prays that the defendants may-
be riled to answer the complaint and show
cause why judgment should not be decreed
for the said sum of money interest and costs.
The defendants demurred generally and
filed a general denial. The demurrer was
overruled and judgment was upon a verdict
of the jury entered tor the ptaintin" with the
specific direction that the execution sltould be
levied and made exclusively nf the separate
(roods chattels and estate of the said". Mary

man at djjkccun'on of the note there can
be no qamr-Bof the correctness of the judg-
ment rHfs us it is in its operation exclu-
sively toWljaXparatc property of the wife.

of bis wile contracted befure marriage was
in several cases decided at the lost term viz :
Callahan vs. Patterson and wife and P. How-
ard and wife vs. North. Nor is he made lia-
ble by this judgment. It can he enforced only
against the wife's individual property ft
docs not lie with the appellant to complain of
this judgment at least upon the ground that
it involves the husUind in any responsibility
for this is not the case. Had the wife or the
appellee claimed that the execution should
be made' as well out of the community ns out
of the separate property of the wile a ques-
tion might have been presented which would
have required consideration especially ns
under the law of 1S-10. which was prooably
in force at the date of the intermarriage of
these (Kitties alt the property brought into the
marriage except the lauds slaves of the par-
ties and the jaraphcrnalia of the wife be

the separate right ol each jiartucr.
There is no reason why the debt of the
husband antecedent to marriage should be

would not apply with equal force to the debt
of the wife contracted feme sole JJut I do
not intend in this place to intimatvitny opin-
ion that the community can be charged with
liabilities of this character incurred by other
members of the matrimonial partnership.
The only question in the case is the alleged
error in overruling the demurrers. The plain-
till' must by law make a full and clear state-
ment of his cause of nclion and such addition-
al allegations jiertiiicttt lo the cnue ns he
may deem necessity to Sudani the suit with
a free statement of the relief sought from the

Harvey the plaintitT complied with these
requisitions of the law.
The petition is inartificially drawn but on
considering the matters set forth rejecting im-
material statements we arc of the opinion
that (hcqucstion above propounded must be
answered in the affirmative.
The residence of the parties nnd the execu-
tion of the note by the defendant Mary arc
allege. 1. The facts that the said dcl'c'ndjut
was a single woman at the inception of the
contract and her subsequent intermarriage
arc not us they should have been explicitly
stated. But the averments that she was Ma-
ry Noble when the note was made and that
she is now Mnry Nash the wife of the other
defendant Cooper 13. Nash nrc sufficiently
indicative nf the existence of those facts ft
is alo alleged though not in the proper order
of pleading that the plaintiff is the bearer ol"
the note and that the same has not been paid.
Judgment is prayed tor generally the Court
having the power under such prayers to de-
cree spccificality uppropriatc lo lhe case.
These allegations arc sufficient lo sustain
the suit: the other muttenrset forth arc sur-
plusage nnd may be stricken out without af-
fecting lhe substance of the petition; "argu-
ments inferences and matters of lair-' arc
not to be pleaded but facts only. The alle-
gation ol the joint liability of the deleudants
by reason of the execution of the note though
erroneous is but a conclusion of law nnd is
therefore immaterial. 1 see no objection to
the common law form of declarations on debts
contracted by the wife bclbre marriage strik-
ing out the superfluous matter which incum-
ber such declarations and arc repugnant to
the plain statement of the facts of the cute as
required under our system of procedure.
The declaration allows that the liability was
incurred solely by the wife ; no joint promise

This suit ivas brought on a promissory note.
Thc jury losnd for the defendant end judg-
ment was entered that he should recover his
costs in thai behall expended. The cause
lias been argued and an opinion on the points
discussed wis in the course of preparation
when it was discovered that no final judgment
-lad been entered.
That the defendant should recover his costs
is not a judgtieht which determines lhe mat-
ter in enntnirersy for the defendant. The
jury had fausd in his favor; or. in otlrer tvsrds
that lhe plaintiff was not entitled in law to
a recovery; and thc judgment following the
verdict should have decreed that the plaintifT
take nothing iy his suit and that the defend-
ant go hence nithout dayor be discharged from
hisattendanci on Uie Court; and that he re-
cover hts costi etc. The form of the judg-
ment is immaterial but in substance it must
show intrinsimlly and distinctly and not in-
fereuu'ally that the matters on thc record bad
been determiied in favor of one of the liti-
gants or that tire rights of the parties '"-
gau'on had been adjudicated. The costs arc
regulated by Statute ; and were an incident
or appendage of thc judgment and generally
are recoverable by lhe victor in the contesL
But as an incileiit they cannot be substituted
for the princtptl and a judgment for their re-
covery is not a deciuon of the matter at issue;

to entertain jurisdiction of n judgment for
costs alone where a nonsuit had been taken.
The subject was disculscd nt some lcngthand
the authorities referred to for the definition of
the term judgment vide Stephens on Plead-
ing p. 13S 3 Black's Com. p. 395 and II
was held that a judgment for costs against the
plaintiff and lhe award ol execution docs not
make it a final judgment for costs arc a mere

In Warren vs. Schiinian. Opinion Book (B)
p. 421 the jury found fur the dclcudant and
it was adjudged that he tlioulil recover his
nuts. This judgment was held lo he not
within the cognizance nf thenppcHate Court
ns itdid not in terms dispose of the matter in
controversy nor was any sentence thereby
pronounced on the matter contained in the re-
cord. The verdict and judgment in thalcase

he appointed one harbor master for the city of

formance of his duties as required by this or-
dinance. Sec. '2. That the harbor master shall have
power to appoint a deputy for whose acts he

other vessels in the harbor within the limits of
the port of Galveston and at the wharfs there-

shall be permitted to have their boats towing
astern but they must be kept alongside or at
the davits-r-all vessels ships or other craft
shall be properly moored within twenty-four
hours after their arrival.
Sec. 9. That all vessels lying iu the stream
are to have their jibbooms rigged in and yards
tonned. ecc and while lyius alongside the
wharf on no account are thc yards to be
squared.
bEC IU. That any breacii of either of the
last four preceding sections of this ordinance
shall and does hereby subject the master
of any ship vessel or other craft or any oiher
person whatsoever so offending to a fine of not
less than five dollars nor more than one hun-
dred dollars for each offence or breach afore
said to he recovered before the mayor or any
court of competent jurisdiction.
Sec. 11. That the harbor master be and is
hereby allowed as annual salary for his services
the sum of four hundred dollars which shall
be paid out of the amount collected from the
captains owners dec of vessels to be collect-
ed under this ordinance.
Sec 12. That this ordinance shall be iu
