AMLELL-CARLAND PARK (25.62 -Ac r Surplus Trac t -
WHEREAS, Dr. W. W. Samuell bequeathed through his Will numerous parcel, of
property to the Park and Recreation Board of the City of Dallas for the ben-
efit of its park system which included a farm tract of approximately 120
acres at Garland Road and Northwest Highway now known as "Samnuell-Garland
Park"; and
WHEREAS, following the condemnation of approximately 20 acres by the State
of Texas for Interstate Highway 635 right-of-way, the 134th Judicial District
Court (Cause No. 81893-G) declared the isolated 25.628-acre unimproved tract
northeast of IH 635 unsuitable for park purposes and directed that said land
be sold by the Board and the proceeds placed in trust with the First National
Bank in Dallas, Trustee of the W, W. Samuell Permanent Foundation; and
WHEREAS, in an effort to follow the directive of the Court, the Board has
offered this land for sale continuously since the Decree by maintaining "For
Sale" signs on the property, through discussions with realtors and other
prospective buyers and through public advertising for sealed bids on two
occasions - in February, 1964 when all bids were found insufficient and
unacceptable and later in May, 1969 when the bids were again found unsat-
isfactory; and, in an effort to obtain the best price possible, the Board
stated that it would ". . . receive and consider written proposals for the
purchase of this surplus Samuell tract" (Vol. 15, Page 203); and
WHEREAS, these efforts have culminated in a written proposal dated August
31, 1971 from Rhodes, Inc. in the amount of $650,000.00 subject to conditions
outlined in a proposed sales contract; and
WHEREAS, a Board Committee composed of Mrs. Ebby Halliday Acers, Mr. J. D.
Wright and Mr. Floyd V. Gish have analyzed the proposal and recommend its
acceptance. Now, Therefore,
BE IT RESOLVED BY THE PARK AND RECREATION BOARD OF THE CITY OF DALLAS:
SECTION 1: That the offer to purchase the 25.628-acre Samuell-Garland sur-
plus tract for $650,000.00 from Rhodes, Inc. in letter dated August 31, 1971,
signed by Mr. T. H. McKey, Jr., Vice President, be accepted subject to the
following special provisions:
1. The purchaser shall pay for all title expenses and closing costs.
2. Sale shall be closed on or before 60 days from date of acceptance
by the City of Dallas.
3. Applicable taxes paid by the purchaser shall be assessed from date
of conveyance.
4. The $65,000.00 check deposited by the purchaser as earnest money
shall be applied as part-payment of the total purchase price at
the time the sale is consummated.
SECTION 2: That this action be certified to the City Council of the City
of Dallas with the recommendation that it be approved; that the City Attor-
ney be directed to prepare such instruments and initiate such procedures as
may be necessary to effect the consummation of the sale and transfer of receipt
to the First National Bank in Dallas, Trustee of the W. W. Samuell Permanent
Foundation; and that the President of the Park and Recreation Board and the
City Manager be authorized to execute instruments of conveyance to the
purchaser.
SECiION 3: That this resolution shall take effect immediately from and
after its passage as in the Charter in such cases as made and provided.
