The commission's chair 2 may, on the recommendation of the executive director, deny a 3 request for review under this section. 4 (b) If the commission reviews and analyzes legislation 5 proposing the regulation of an occupation, the commission shall 6 submit a report to the legislature before the start of the next 7 legislative session regarding the commission's findings on the need 8 for regulating the occupation and the type of regulation 9 recommended, if any. 10 (c) In analyzing legislation proposing the creation of an 11 occupational licensing program, the commission shall determine 12 whether : 13 (1) the unregulated practice of the occupation would 14 be inconsistent with the public interest as defined by Section 15 325.0115; 16 (2) the public can reasonably be expected to benefit 17 from an assurance of initial and continuing professional skill sets 18 or competencies; and 19 (3) the public can be more effectively protected by 20 means other than state regulation. 21 (d) If the commission reviews and analyzes proposed 22 legislation amending an existing occupational licensing program, 23 the commission shall submit a report to the legislature before the 24 start of the next legislative session regarding the commission's 25 findings on the need for the proposed legislation. 26 SECTION 3. This Act takes effect September i, 2013.
