Lipscomb County .-—Greeting:
You are hereby commanded tu
summon M. C. Smith and the heirs of
said M. C. Smith, whose names are
nnknown to plaintiff, to appear at the
next regular term of -the District
Court of Lipscomb County in and for
the 31st Judicial District of Texas, to
be held at the Court house in the
town of Lipscomb, on the lyth day
of November, 1928, then and thert
to answer a petition filed in said
Court on the 12th day of October
1828, in a cause numbered 529,
wherein John L. Mercer is plaintiff
and M. C. Smith and the unknowi
heirs of M. C. Smith are defendants
the cause of action alleged being a<
follows:
That plaintiff owns in fee simplt
the East Half of Section No. 157,
Block No. 10, in Lipscomb County
Texas; that he acquired title to said
land under the Texas statutes oi
limitation and by virtue of the fol
lowing conveyances: (a) a quit-claim
deed of Stewart Gordon to Arthur
R. Turner, dated September 17, 1917
recorded in book 25, page 342, Lips
comb County Deed Records; (b)
quit-claim deed of Arthur R. Turnei
. to Thomas A. Lemaster, dated March
80, 1918, recorded in book 27, page
169, Lipscomb County Deed Records
<c) warranty daad of Thomas A. Le-
master to Lewis Blau dated Apru
26, 1919, recorded in book 29, page
12.5, Lipscomb County Deed Records;
<d) warranty deed of Lewis Blau and
Lorton and wife to the Winfield Na
tional Bank, dated June 4, 1927,
recorded in book 40, page 207, Lips
comb County Deed Records; (f)
special warranty deed of the Winfielti
National Bank to plaintiff, dated
February 28, 1927, recorded in book
40, page 141, Lipscpmb (bounty Deed
Records; (g) on August 11, 1888, B.
F. Weems, as Receiver of the City
National Bank of Houston, conveyed
said land to the defendant, M. C.
Smith, but the records of Lipscomb
County do not disclose any convey-
ance of said land by said Smith to
any other person, said deed from
Weems to Smith being recorded in
book 1, page 477, Lipscomb County
Deed Records; that upon the convey-
ance of said tract by said Gordon tc
said Turner, the latter went into pos-
session thereof and continuously
thereafter he and his said successors
in title remained and still remain in
possession of said land, holding same
peaceably and adversely to all per-
sons, cultivating, using and enjoying
same and paying taxes thereon and
claiming same under the deeds exe-
cuted and delivered to them, all of
which have been registered; that
plaintiff is now in possession thereof
and is^holding such possession peac-
ably and adversely to all persons and
is cultivating, using and enjoying
same under the' above several con-
veyances, beginning with that of Sep-
tember 17, 1917; that at all times
material to this action said land has
been actually enclosed by a good
and sufficient fence and that plain-
tiff's title has been perfected by the
statutes of limitation of five and ten
years; that by reason of the failure
to record the conveyance of said M.
C. Smith in Lipscomb County a cloud
rests upon plaintiff's title and his
title is subject to criticism or rejec-
tion for such reason and that he is
entitled to have such cloud removed
and his title quieted.
You are further commanded to
serve this citation by publishing the
same once in each week for four con.
secutive weeks previous to return day
hereof in a newspaper published in
your county; but if no newspaper is
published in said county, then in the
nearest county where a newspaper is
published.
Herein fail not, but have you be-
fore said court, pn the first day of
the next term thereof, this writ, with
your return thereon, showing how
you have executed the same.
