AGREEMENT
I
Officers Have at Last Cleaned
the City of Whiskey Sellers
REMAIN AWAY TEN YEARS

special counsel I. J. Rice and
Sheriff Emison yesterday con-
cluded negotiations with the par-ties-who
have at various times
and are to not come back for a
period of ten years except for a
visitmot to exceed five days.
The matter was carefully con-
sidered by the officersand many
prominent citizens who have al-
ways shown interest in the en-
forcement of the local option
laws were consulted. The ofh-
cers made the agreement very
binding on the violators as will
be seel by reading the terms of
tht contract. This exodus of
sixteen men who have for the
past few years been responsible
for the majority of the local op-
tion violations will leave Brown-
wood free from bootleggers and
the officers will keep a diligent
watch for new ones.
The terms of the agreement
are as follows:

L. McGaugh County Attorney
-of "Brown county Texas and I. J.
Rice special counsel for the state
parties of the firFt part and the
ixteen persons signed below of
the second part "Witnesseth:
That whereas there are a num-
ber of indictments and informa-
tions filed against certain parties
to this contract for violating
what is known as the Local Op-
tion Law; there aTe also certain
motions for contempt of court
filed against certain parties to
this contract and whereas the
State of Texas through counsel
above mentioned are threatning
to file other informations for the
violations of said law and other
motions for contempt of the
court and its process airainst
certain parties hereto and
whereas parties of the second
part desire to avoid prosecutions
under the said indictments in-
formations and motions for con-
tempt. Therefore the said R. L. Mc-
Gaugh and I. J Rice represent-
ing the state in . said prosecu-

Parties of the second part
hereby agree iu conideration of
the indulgences above mentioned
not to sell intoxicating liquors in
Brown County Texas at any
time in the future. They also
agree for themselves and each
other to permanently remove
from the city of Brownwood
Texas within ten days from the
date of this contract and to con-
stantly and permanently remain
away from said city of Brown-
wood for a period of ten years
from the date hereof.
But in as much as Cad Ben-
nett one of the parties hereto
owns a home in the city of
Brownwood and desires to en-
gage in a business which requir-
es him to travel he is allowed un-
der this agreement to keep his
family here provided he in no
way keeps a place of business
up town or engages in handling
or selling intoxicating liquor
either by wholesale or retail in
Brown county Texas.
This agreement shall not affect
the performing of any sentence
heretofore imposed upon any
party to this agreement. There-
fore if such party shall from
necessity remain in the city of
Brownwood for the sole purpose
of performing such sentence and
only so long as" it is necessary to
perlorm same he shall not be
considered as violating this
agreement. But as to cases
pending no obligation shall. rest'
upon any party to this agree
ment to attend any court under
any case or motion now pending
unless he or his bondsmen are
notified especially to be present.
All parties hereto against
whom cases or motions are pend-
ing shall" keep their bondsmen
notified as to their whereabouts
at all times or shall notify the
prosecuting attorney or sheriff
of their whereabouts so that they
may be had if this agreement is
violated.
In the event any party to
this agreement shall violate the
same or any part thereof the
same shall be void and shall re-
lease the parties of the first part
from their obligations taken
herein as to all parties hereto
unless parties hereto not guilty
of violating this agreement shall
assist the state in all ways pos-
sible to prosecute and convict
the parties violating this agree-
ment in any case now pending or
in any case of motion hereafter
filed against them for violating
the Local Option Law or con-
tempt of court.
This agreement shall have no
effect on any case which has
heretofore been tried whether on
appeal or not and shall have no
affect as to any penalty or penal-
ties heretofore imposed.
It is understood and agreed
that no suits for damages shall
be filed or prosecuted against
the Sheriff or any constable of
Brown county Texas on account
of any seizure or seizures hereto-
fore made under what is termed
and known as the Search and
Seizure law passed by the last
egislature. j
It is further agreed that a vis
it to Brownwood on business or
o relatives. for not exceeding
five days in length at any one
ime shall not be considered a
violation of this contract.

County Needs the Work.
Commissioner D. P. Malone is
in town today to see about work-
ing the county convicts on the
road Mr. Malone says there
are seven men now connnea in
the jail that can and should be
worked. There are others who
perhaps could be worked for
short times but seven of the
number in jail have good pros-
pects of remaining for a long;
time and it is believed by many
that they should be worked.
If satisfactory arrangements
can be made the convicts will be
pat on the road at once.
It is noticeable that in other
places the county authorities
have found it a profitable busi-
ness working convicts and the
question is asked "Why can't
Brown county do the same?"
There is but one answer and
chat is she could if she would but
fix up for the work and put the
men on the roads instead of par-
doning them.
