SUBCHAPTER Q. APPROVAL OF
OFF-CAMPUS AND SELF-SUPPORTING
COURSES AND PROGRAMS FOR PUBLIC
INSTITUTIONS
19 TAC 4.271
The Texas Higher Education Coordinating Board (Coordinating
Board) proposes an amendment to 4.271, concerning the
authority for the approval of off-campus and self-supporting
courses and programs for public institutions. The intent of the
amendment is to renumber the reference to the cited section of
the Texas Education Code from 61.051(j) to 61.0512(g), per
Senate Bill 215, 83rd Texas Legislature, Regular Session.
Dr. Stacey Silverman, Interim Assistant Commissioner for Work-
force, Academic Affairs and Research, has determined that for
the first five years the amendment is in effect, there will be no
fiscal implications for state or local governments as a result of
amending the section.
Dr. Silverman has also determined that no effect on public ben-
efits or local employment is anticipated as a result of the amend-
ment. There is no effect on small businesses. There are no
anticipated economic costs to persons who are required to com-
ply with the section as proposed.
Comments on the proposed amendment may be submitted

sioner, Texas Higher Education Coordinating Board, P.O.
Box 12788, Austin, Texas 78711 or via email at WAARcom-

The amendment is proposed under the Texas Education Code,
Chapter 61, 61.0512(g), which provides the Coordinating Board
with the authority to administer the programs.
The amendment affects Texas Education Code, 61.0512.
4.271. Authority.
Authority for this subchapter [these provisions] is provided by Texas
Education Code 61.0512(g) [61.051(j ] which provides the Board
with the authority to approve courses for credit and distance education
programs, including off-campus and self-supporting programs, and
Texas Education Code 130.008 and 28.009, which provide for
the offering of dual credit courses by public institutions of higher
education.
This agency hereby certifies that the proposal has been reviewed
by legal counsel and found to be within the agency's legal author-
ity to adopt.

SUBCHAPTER R. REVIEW OF LOW-
PRODUCING DEGREE PROGRAMS
19 TAC 4.286, 4.287, 4.290
The Texas Higher Education Coordinating Board (Coordinating
Board) proposes amendments to 4.286, 4.287, and 4.290,
concerning the review of low-producing degree programs.
These amendments are adopted on an emergency basis else-
where in this issue, and now are being proposed to allow for a
30-day comment period. The intent of the amendments is to
incorporate into existing rules a statutory change in the authority
of the Board. The Board no longer has the authority to order
the closure or consolidation of degree programs at institutions
of higher education, but may instead issue recommendations
for closure or consolidation to the institution and its governing
board. The amended sections reflect this change in authority.
Dr. Stacey Silverman, Interim Assistant Commissioner for Work-
force, Academic Affairs and Research, has determined that for
the first five years there will be no fiscal implications for state or
local governments as a result of amending the sections.
Dr. Silverman has also determined that for the first five years
the amendments are in effect, the public benefits anticipated as a
result of administering the sections will be to give institutions and
their governing boards direct authority over decisions regarding
the closure or consolidation of degree programs. There is no
effect on small businesses. There are no anticipated economic
costs to persons who are required to comply with the sections
as proposed. There is no impact on local employment.

have the following meanings, unless the context clearly indicates oth-
erwise:
