535.208. Application for a License.
(a) A person desiring to be licensed shall file an application
using forms prescribed by the commission. The commission may re-
quire an applicant to furnish materials such as source outlines, syllabi,
course descriptions or official transcripts to verify course content or
credit to meet education requirements. The commission may not ac-
cept an application for filing if the application is materially incomplete
or the application is not accompanied by the appropriate fee. The com-
mission may not issue a license unless the applicant:

(5) submits proof of financial responsibility as required by
1102.1141 of Chapter 1102 using a form approved by the commission

further evaluation or processing when one of the following events oc-
curs.
(1) The applicant fails to satisfy a current education re-
quirement or examination requirement within 12 [six] months from the
date the application is accepted for filing.

(5) The applicant fails to provide fingerprints to the Depart-
ment of Public Safety within 12 months from the date the application
is filed.

535.209. Examinations.

(e) If the applicant has not satisfied all requirements within
one year from the time the commission accepted an application for
filing, including passing both parts of the examination, the application
is terminated and a new application is required.
(f) Successful completion of both parts of the examination is
valid for a period of 24 months.
(g) An applicant who fails the examination three consecutive
times may not apply for reexamination or submit a new license appli-
cation unless the applicant submits evidence satisfactory to the com-
mission that the applicant has completed additional core education as
follows, after the date the applicant failed the examination for the third
time:
(1) for an applicant for a professional inspector license, 15
hours for a scaled score of 70 to 74;
(2) for an application for a professional and real estate in-
spector license:
(A) 30 hours for a scaled score of 65 to 69;
(B) 45 hours for a scaled score of 60 to 64; and
(C) 60 hours for a scaled score of 59 or lower.
535.210. Fees.
(a) The commission shall charge and collect the following
fees:(1) - (10) (No change.)
(11) a fee of $40 for preparing a certificate of license his-
tory, active licensure, or sponsorship;

(17) a fee of $400 for filing an application for accredita-
tion as an Inspector Continuing Education (ICE) provider for a period
of two years under Texas Occupations Code 1102.205 [when such ae-

(21) a fee of $100 for deposit in the real estate inspection
recovery fund upon an applicant's successful completion of an exami-
nation; [and]
(22) fee of $20 for filing any application, renewal, change
request, or other record on paper that a person may otherwise file with
the commission electronically by accessing the commission's website,
entering the required information online, and paying the appropriate
fee;[.]
(23) a fee of $40.50 for the annual late renewal of an ap-
prentice inspector license for a person whose license has been expired
90 days or less;
(24) a fee of $54 for the annual late renewal of an appren-
tice inspector license for a person whose license has been expired more
than 90 days but less than six months;
(25) a fee of $48 for the annual late renewal of a real estate
or professional inspector license for a person whose license has been
expired 90 days or less;
(26) a fee of $64 for the annual late renewal of a real estate
or professional inspector license for a person whose license has been
expired more than 90 days but less than six months; and
(27) the fee charged by the Federal Bureau of Investigation
and Texas Department of Public Safety for fingerprinting or other ser-
vice for a national or state criminal history check in connection with a
license application or renewal.

535.211. Financial Responsibility as Required by 1102.1141

(a) When an applicant for a license issued under Texas Occu-
pations Code, Chapter 1102 (Chapter 1102), has met all other licensing
requirements, the commission shall notify the applicant that the ap-
plicant must provide proof of financial responsibility as required by
1102.1141 of Chapter 1102 (Financial Responsibility) [professional
liability insuran ee- r any other insurance that provides coverage for

before the license will be issued.
(b) An inspector must maintain financial responsibility

sibility using a form approved by the commission for that purpose
