The Texas Higher Education Coordinating Board (Coordinating
Board) proposes new 5.56, concerning approval of baccalaure-
ate degree programs for selected community colleges. This new
section is adopted on an emergency basis in this issue of the
Texas Register, and is proposed to allow for a 30 day comment
period. The intent of the new section is to incorporate into ex-
isting rules changes and provisions enacted by Senate Bill 215,
83rd Texas Legislature, Regular Session.
The new section provides rules for the approval of baccalaureate
degree requests from selected public community colleges.
Dr. Stacey Silverman, Interim Assistant Commissioner for Work-
force, Academic Affairs and Research, has determined that for
the first five years the new section is in effect, there will be no
fiscal implications for state or local governments as a result of
the new section.
Dr. Silverman has also determined that for the first five years the
new section is in effect, the public benefits anticipated as a re-
sult of administering the section will be to streamline the approval
procedures for new baccalaureate programs for community col-
leges authorized by state law to offer such degrees. There is no
effect on small businesses. There are no anticipated economic
costs to persons who are required to comply with the section as
proposed. There is no impact on local employment.

Public community colleges authorized by the Board to offer baccalau-

submit requests for new baccalaureate degree programs if:
(1) the proposed degree program has the approval of the
college's governing board;
(2) the proposed degree program is not an engineering pro-
gram; and
(3) the addition of the proposed program to the college's
inventory would not exceed five total approved baccalaureate degree
programs.
This agency hereby certifies that the proposal has been reviewed

ity to adopt.

SUBCHAPTER A. GENERAL PROVISIONS

The Texas Higher Education Coordinating Board (Coordinating
Board) proposes amendments to 7.3 and 7.8, concerning De-
gree Granting Colleges and Universities Other Than Texas Pub-
lic Institutions. These amendments are adopted on an emer-
gency basis in this issue of the Texas Register, and are proposed
to allow for a 30 day comment period.
The amendment to 7.3 adds a definition for "professional de-
gree," and renumbers subsequent paragraphs.
The amendment to 7.8 sets forth the prohibition against issuing
a Certificate of Authority for a foreign-chartered or foreign-based
private postsecondary institution to grant a professional degree
or to represent that credits earned in Texas are applicable toward
a degree. This prohibition was added through passage of Senate
Bill 215 by the 83rd Texas Legislature and signed by Governor
Perry on June 14, 2013.
Dr. Stacey Silverman, Interim Assistant Commissioner for Work-
force, Academic Affairs and Research, has determined that for
the first five years the amendments are in effect, there would be
no fiscal implication for the state or local governments as a result
of amending the sections.
Dr. Silverman has also determined that for the first five years the
amendments are in effect, the public benefits anticipated as a re-
sult of the amendments will be to ensure that Texas-based and
other US-based institutions granting a professional degree or
representing that credits earned in Texas are applicable toward a
