Chapter 1220 S.B. No. 498 S.B. No. 498 1 AN ACT 2 relating to the trapping and transport of surplus white-tailed 3 deer. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Subsections (a) through (h) and (k), Section 6 43.0612, Parks and Wildlife Code, are amended to read as follows: 7 (a) In this section: 8 (1) "Property[l, ~-e~ty] owners' association" has 9 the meaning assigned by Section 202.001, Property Code. 10 (2) "Qualified individual" means an individual who has 11 a wildlife management plan approved by the department. 12 (b) The department may issue to a qualified individual, a 13 political subdivision, or a property owners' association a permit 14 authorizing the trapping and transporting of surplus white-tailed
15 deer found on the property owned by the qualified individual or 16 within the boundaries of the political subdivision or the 17 geographic -area in which property subject to the property owners' 18 association is located. 19 (c) Not later than the 30th day before the date of the first 20 planned trapping and transporting of white-tailed deer, a qualified 21 individual, a political subdivision, or a property owners' 22 association shall file with the department an application showing 23 that an overpopulation of white-tailed deer exists on [within] the 24 property owned by the qualified individual or within the boundaries
