Chapter 240 H.B. No. 707 1 AN ACT 2 relating to the validation of certain governmental acts and 3 proceedings of certain municipalities relating to certain public 4 improvement districts. 5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 6 SECTION 1. This Act applies only to a municipality with a 7 population of 500 or less according to the 2000 federal census. 8 SECTION 2. (a) All governmental acts and proceedings of a 9 governing body of a municipality under Subchapter A, Chapter 372, 10 Local Government Code, taken or occurring before the effective date 11 of this Act, to establish a public improvement district, designate 12 improvements, levy assessments, or finance costs of improvements, 13 are validated. 14 (b) This section does not apply to: 15 (1) an act or proceeding the validity of which is the 16 subject of litigation that is pending on the effective date of this 17 Act; or 18 (2) a governmental act or proceeding that, under the 19 law of this state at the time the act or proceeding occurred, was a 20 misdemeanor or a felony. 21 SECTION 3. This Act takes effect immediately if it receives 22 a vote of two-thirds of all the members elected to each house, as 23 provided by Section 39, Article III, Texas Constitution.
