3I S.B. No. 1540
1 (a) A contract in the amount of more than $15,000 for the
2 construction 0 improvements or the purchase of material,
3 mchne y, equipment, supplies, or any other property except real
4 property may be awarded only through competitive bidding after
5 notice is published in a newspaper of general circulation in the
6 district at least 15 days before the date set for receiving bids.
7 (b) A board may adopt rules governing the taking of bids and
8 the awarding of contracts.
9 (c) This section doer not apply to:
10 (1) personal or professional services;
11 ,(2) the acquisition of an existing rail transportation
12 sysft em;
13 . (3) a contract with a common carrier to construct
14 li es and to operate commuter rail service on lines wholly or partly
15 owned by the carrier; or
16 (4) an agreed nt with a private entity under Section
17 173.156. (V.A.C.S. Art. 65 0c-1, Sec. 6.)
S ec. 173.159. EMINT DOMAIN. (a) A district may exercise 3
19 the porer of eminent domain, to acquire:
20 : : i (1) land in fee simple; or
21 (2) any interest less than fee simple in, on, under, or
22 above land, including an easement, right-of-way, or right of use of
23 airspace or subsurface space.
24 (b) The power of eminent domain under this section does not
25 apply to:
26 I (1) land under the jurisdiction of the department or a
27 metropolitan transit authority; or
