Company usually, or if he had one at all?
A He has had an overcoat, one I remember with no cape on it.
Q Has he that coat now?
A I don't know whether he has got it now or not.
Q Do you know if he had it the next day after you had seen him wearing one with
a cape to it?
A I never paid any notice at all as to whether he did or not.
Q Do you know a soldier by the name of Peter Dehoney in your troop?
A Yes Sir.
Q Do you know if he had a Cavalry overcoat with a cape to it, about the 8th of this
month?
A Well, I have seen him wear one like that. I don't know whether it was his'n or
not. I don't know that it was not his coat.
Q Do you know if the prisoner slept in his barracks on the night of the eighth

A No Sir, I don't know, I go to bed pretty early at nights.

Thomas, a witness for the prosecution was then duly sworn and testified as fol-

A Sharp Thomas, Pvt. Of Troop H, 10th Cavalry, Fort Davis, Texas.
Q Do you know the prisoner?
A Yes Sir, Pvt. Scott Cain, Troop H, 10 Cavalry.
Q Were you in the troop barracks at about tattoo on the night of the 8th of this
month in company with Pvt. Claggett of your troop and others?
A Yes Sir.
Q Did you see the prisoner there then?
A Yes Sir.
Q Under what circumstances - how do you remember you saw him?
A Well, he came in the quarters, what attracted my attention, he had on a big
Mexican hat, I asked him to let me see it, at the same time, first call had gone
and the First Sergeant hollered, "Outside for Tattoo".
Q What did the prisoner, Cain, do then? Did he go out to tattoo?
A He gave the hat to Corporal Newman and picked up an overcoat off of a bunk
and went out.
Q Do you know from whose bunk he picked up the overcoat?
A He picked it off of Pvt. Dehoney's bunk.66
