debts of those stales at a reduced rate

held the same way but the piple

the former decisions and the aid
of the supreme court of the Uni-
ted Slates was therefore neces-
sary to protect tile rights of the
bondholders. In some of this lili-
gation whero tlm courts would order
the mayor and city council to levy a
tax and pay a debt and tlmsc authori-
ties would refuse to do so bwnna.' they
were restrained by injunction from the
state court tho federal court would put
the whole city government in Jail un-
til they did levy tho necessary lax. in
somo cases the court woum iiirect its
marshal to levy and collect such tax
as was iiocesi-ary to pay the debt. This
lino of decisions governs the policy
to be pursued by tho foreign boudhobl-
era ; ami they further decide that when
bonds are issued and the law which
authorizes the issuisulso provides a tax
to pay the interest on them ainlasink-
ingfundto pay Mm principal when
duethen such law is a contract be-
tween the state and tho bondholder

but that tho tax thus provided must be
collected and tho proceeds implied lo
the use to which It is pledged. Upon
the principle of these decisions whb-h
was applied to the southern debts It
has been arranged to Hunt all the debts
of all these states on the terms propos-
ed. For this purpose Ibis American
bond funding and bunking association
has been organized with sullicient
capital to accomplish its objects. Its
capitalists are among tho strongest
firms in Kuropj interested and dealing
in American securities the Koth-
cliililn (lilliatls and Barings of Lon-
don besides some of the most influen-
tial llnaueial Arms of (Jermaiiy. They
have had the law above referred lo
prepared and they propose to a state
if she will agree to its pro-isions ami
surrender to them the entire control of
its debt then this association binds it-
self to receive these new bonds and to
return to the state the old bonds in ex-
change as soon as they can get posses-
sion of them. The proposed new bond
Is to be made payable in London in
gold coin so as to meet the legal ten-
der decisions of the supreme court and
the rate of interest will vary in each
state according to her ability to pay.
The syndicate controlling this lis-

'quantities of southern securities.
