An Expert Swimmer.
Mr. John L. Jones stenographer in the
oeparnit.ni yesterday evening
swam six miles in the Colorado river. Mr.
Jones ia one of the cleverest athletes in
Austin and every day he take aa maoh
ezeroise aa the average young man would
in a week. When he was only 15 years of
age he was awarded a oertifioste lor swim-
ming over a five mile ooorse in the aqnatio
sports on the river Thames.
An Uninvited Visitor.
Mr. A. Deffenbaogh the venerable day
offloer at the Capitol had a visitor at his
house ia the Eighth ward night before
last who oame uninvited and entered un-
announced. About 11 o'clock at night
Mr. Deffenbaogh heard an unusual noise
in his bed-room and soon some object
jumped upon the bureau. Be straok a
light and was surprised to find yonng
opossum grinning on top of this useful
article of furniture. Mr. Dtffenbangh
killed the opossum and retained his hide
as a memento of snob an unusual noo-
tnrnal visitor.

Orange Blossoms.
Mr. Q. W. Chapman a well-known and
highly respected citizen of l'ravis oonnty
was marriej yesterday to Miss Harriet
Shaedon a beantiful and aooomplished
yonng lady of this oity. The ceremony
was elegantly performed by Justice Cal-
houn at his offloe. The bride and groom
will probably visit Oatmanville on their
bridal tour. The friends of these charm-
ing young people wish them a happy and
prosperous future.
Regardless of the Weather.
It apparently never gets too hot for ioe
cream nor marrying and giving in mar-
riage. Notwithstanding the calorifio in-
tensity of the oiroumambient atmosphere
yesterday there were several marriage
licenses issued as follows:

Texas Dental Association.
The ninth Bnnnai meeting of the Texas
Dental association will be held at Galves-
ton beginning Monday August 19 at 10
o'olook a. m.
The Southern Dental association will
meet at the same place on Tuesday morn-
ing August 20.
Dr. Crawford president through Dr. M.
O. Marshall reoording secretary extends
the following invitation to the dentists of
Texas:
"We expect and desire that yon take
part in our meeting and yon will be bo-
corded all the privileges of the associa-
tion. Any papers yon may prepare will
come np nnder the proper oommittee and
we hope to get muoh matter from you."
This meeting promises to be the great-
est event in dentistry in the history of
Texas. Papers discussions and olinios by
the ablest men in the south.
The Festive Burglar.
The bnrglar was abroad night before
last and seoured sufficient cash to keep
him from manual labor for a week or two
if his habits are not too expensive. He
visited the residences of Mr. Rhodes
Fisher and Mr. G. A. Searight. Ha ef-
fected an entranoe into Mr. Searight's
residenoe by raising a window opening
into the parlor and then polling
himself in. Having gained the interior
he. prooeeded to gather in the oaeh that
happened to be attainable. He seoured
$66 and then oontinued his investigations
toward the residenoe of Mr. Fisher. He
was not so fortunate here however. The
offioers were notified of the robberies.
The Alliance Cotton Yard.
The board of direotors of the Allianoe
cotton yard held a meeting yesterday
morning. The object of the meeting
was to seleot a manager for the yard
whioh will soon be open for business.
The board elected Mr. 8. C. Oranberry as
general manager and the selection is a
most exoellent one having alike the confi-
dence of the farmers and the cotton men.
The yard will be ready for business in
abont ten days.

Body Found.
The unfortunate drowning of yonng
Edgar Daniell was the prinoipal theme of
discussion on the streets yesterday and
expressions of regret and sympathy for
the parents were universally beard.
It now transpires that it was "Rip"
Mnsgrove the young son of offloer Al
Musgrove at the oapitol who saved the
life of the boy known as "Diitoh Joe."
The young fellow is an expert swimmer
for a boy and aoted heroioally. .
Sergeant Palmer and a nnmber ot
others worked all day at the river trying
to bring thfbody to the surface of the
water. Dynamite cartridges were ex-
ploded and the river was drBgged in vain.
The river was scoured for four miles below
the oity.
About dark news reaohed the oity that
the body bad been found floating in the
river about eight miles below the oity.
Messrp. R. M. Kell and D. Rogers were
fishing when their attention was drawn to
an objeot floating in the river. Ihey
succeeded in getting the body out on the
bank and having read in Thb Btatbbmas

found his body. They hastened at oaoe
to this oity aod a wagon was dispatched

An Expert Teacher of Mannal
Training Can Be Employed
in Free Schools.
Yesterday morning Jndge Fulmore re-
ceived through the mail the following im-
portant ruling from Superintendent 0. H.
Cooper: '

Committee from the Aastia bchool Board Aus-
tin Texas:
Gentlemen By your communication of
the 27th lust. you state that the Austin
school board desired to ioanjurate
a manual training department in
connection with yonr sohools that yon
wish instruction in mannal training to be
given during sohool hours by an expert
apparatus being specially seoured for the
purpose and yon ask if (there is any
prohibition in the law against your pay
ing the salary of such expert out of the
general revenue whioh jou derive for the
support of the sohools out of the state
and looal taxation.
In reply I beg to advise yon as follows:
There is no provision in the Constitution
of the state or of the general sohool law
whioh limits the Hoope of instruction in
public free schools. On the other hand
the general law fixes as a minimum oer-
tain subjects suoh as "Othography"
"Reading in English" "Penmanship" etc
and allows trustees to fix upon other
branohes or the state superintendent to
direot that instruction be given in other
branohes. The powers possessed by the
boards of trustees in independent sohool
districts are more extensive than those in
ordinary sohool districts. By sec 6 of
the aot of 1879 page 76 it is prescribed
that said "board of trustees shall
have and exeroise exclusively the
same powers control management
and government of and over snoh publio
free sohools and institutions of learning
in suoh oities and towns as are now or
hereafter may be by law oonferred upon
the oounoil or board of aldermen of such
cities or towns where suoh oounoil or
board of aldermen are invested with the
oontrol of suoh publio free sohools."
The powers of the oounoil or board ' of
aldermen as defined in Article 8787 Re-
vised Civil Statutes are as follows: "The
oounoil or board of aldermen of suoh city
or town are invested with exolnsive
power to maintain regulate oontrol and
govern all publio sohools now established
or hereafter to be established within the
limits of said oity or town and they are
furthermore authorized to pass such or-
dinances rules and regulations not incon-
sistent with the Constitntlon and laws as
may be neoessary to establish and main-
tain free sohools purohase building sites
construct sohool houses and generally
promote free publio eduoation within the
limits of their respective oities aod
towns."
Thj establishment of a department of
manual training in the publio schools of
the oity of Austin is held "generally to
promote free pnblio eduoation" within the
limits of the oity. Aooording to my view
of the matter therefore there oan be no
question that the board of trustees of the
oity of Austin will have the right to pay
the salary of snoh expert as it may be
neoessary to employ to give manual train-
ing in the schools from the funds derived
from the state and local taxes for the sup-

Some of the eastern papers have already
began to get the views of the governors
of the different states as to the proper
place to huld the celebration of the four
hundredth anniversary of the discovery of
Amerioa by Columbus and In this connec-
tion it may be stated that Gov. Ross is ia
favor of some Texaa oity as first ohoioe
and St. Louis as second ohoioe.

EDUCATIONAL DKPABTMBNT.
The following extraots are made from
a letter received by Superintendent
Cooper from a oonnty judge ia regard to
sohool matters in his county:
"Our oonnty levies and oollects a speoial
tax of 20 oents on the $100 for school
purposes and has been doing so for three
years. Oar people pay the speoial sohool
tax without a murmur. We have plenty
of oaeh on hand to pay teaohers. Our
sohool term is ten months and we could
run our schools all the year if we so de-
sired. Last year our looal tax yielded
$853. Our entire aobo-
lustio population is only 175 and our en-
tire revenue from all souroes for' the next
eoholastio year will be more than $2615
whioh I think is fair for a population
of 175. We oolleot nothing for 'overs'
and 'nnders' and haye no private sub-
scription. Oar people believe that 'the
publio sohools are a public benefit and the
publio supports oar sohools and they are
publio free sohools in every sense abso-
lutely as free as the doors of the churoh.
I know that looal tax-
ation is the only way to make our sohools
better. Then the law should be repealed
allowing a oharge to be made for overs
and nnders. It keeps many ohildren away
from sohool."

Commissioner Foster was la his office
yesterday having returned from San An-
tonio. While in that oity Mr. Foster au-
thorized the Texas Fire and Marine In-
surance oompany to oommenoe business.
ThU is the second Texas fire oompany in
existence. It has an authorized capital
of $1000000 and a paid op capital of
$103000.

Commercial report MoKinney.
The commercial reports of the oities of
Texas whioh are received dally at the ag-
ricultural department tell a tale and point
to a moral. Aooording to the report of
the town of MoKinney just -received
that place has a population of
only 6000 people. The town last
year sold $150000 worth of agricultural
implements 15000 bales of ootton and
125000 bushels of oorn; 250000 bushels of
wheat were shipped together with $140-
000 worth of livestook. The town last
year spent $500000 on publio improve-
ments. The oombined mercantile trans-
actions of the year aggregated $1500000
and the taxable wealth of the town foots
up $1230780. This little town also has
$192000 invested in manufacturing en-
terpilses. ATTOBNBY-GENEBAL S OFFIOB.
Some days ago a telegram was sent out
from New York to some Texas paper that
the reorganization of the Houston and
Texas Central railway was retarded by the
fact that there was a clash between the
attorney-general and the attorneys for
the railroad in regard to certain pro-
visions in the oharter. It is understood
that there was never but one oharter
by the Houston and Texas Central people
presented to the attorney-general and that
was done on Tuesday. This charter was
approved by the attorney-general as
drawn in compliance with the law in every
respeot. The faot.however that this oharter
has not yet been filed in the offloe of
seoretary of state has given rise to a re
port that there was some hitch. Suoh
however does not appear to be the case.
The oharter has not yet been filed prob-
ably beoause the railroad people had not
oonoluded their reorganization scheme.

The oharter of the new Houston and
Texas Central Railway oompany was filed
yesterday in the offioe of seoretary of
state. The incorporators are: Frederiok

of New York; Geo. 8. Ellis of Long
Island N. Y.; Henry E. Molin of New
York; Frank W. Emery of New York;
Frank L. Grant of Brooklyn; James N.
Wallace of Jersey City; John
Q. Adams of Orange N. Y.; Philip
S. Babcock of Brooklyn; W. H. Lndlnm
of Staten Island N. Y. The road is under
the management and oontrol of the follow-

Commissioner Foster yesterday received
the oommeroial report of the city of
Gainesville and it shows the city to be in
a very flourishing condition. The popu-
lation has inoreased from 1500 in 1880 to
10000 and the assessed valuea have in-
oreased from $2218849 in 1880 to $6 602-
923. The city has thirty-eight manufac-
turing establishments with a capital or
$318000. Last year they used $435844
worth of raw material and the output was
$674627. There were employed 165 men.
The city last year snld 26000 balea of oot-
ton worth $1203760. There were sold
also during the year 75000 pounds of
wool $64000 worth of hides and furs and
7996 head of cattle bringing $159920.
The city expended in publio Improve-
ments last year $200000.

It is also a f aot worthy of mention that in
the month of July an unusually large pro
portion of the lands sold were in toe old
settled oonnties and not in the wild wild
west.
STATB OEOIiOOIOAL DEPABTMENT.
State Geologist Dumble yesterday re-
oeived a letter from his assistant Dr.
Oomstook who has been at work in Bar-
net. He has finished up his work in that
oonnty and yesterday went to Llano
oonnty to begin work. He wrote that the
Colorado river was past fording np there
and was very high. This rise will prob-
ably reaoh here to-night.
EDUOATION AI DEPABTMENT.
Supeainteodent Cooper will not be able
to visit the Normal sohools as he desired
and intended on aooouut of the press of
business at this season of the year. He
is now preparing a oourse of study for the
oonntry sohools.
STATB TBEABUBEB'S OFFICE.
The treasurer is now prepared to pay
all registered sohool warrants. Yesterday
he paid out $50000 on this aooout.
