The Texas Racing Commission (Commission) files this notice of in-
tent to review Chapter 311, concerning Other Licenses. This review is
conducted pursuant to the Texas Government Code, 2001.039, which
requires state agencies to review and consider for re-adoption their ad-
ministrative rules every four years.
The review shall assess whether the reasons for initially adopting the
rules within the chapter continue to exist and whether any changes to
the rules should be made.
All comments or questions in response to this notice of rule review may
be submitted in writing to Carolyn Weiss, Assistant to the Executive
Director of the Texas Racing Commission, at P.O. Box 12080, Austin,
Texas 78711-2080, telephone (512) 833-6699, or fax (512) 833-6907.
The Commission will accept public comments regarding the chapter
and the rules within it for 30 days following publication of this notice
in the Texas Register
Any proposed changes to the rules within Chapter 311 as a result of
the review will be published in the Proposed Rules section of the Texas
Register and will be open for an additional 30-day public comment

Adopted Rule Reviews
Employees Retirement System of Texas
Title 34, Part 4
Pursuant to the notice of the proposed rule review published in the Jan-
uary 21, 2011, issue of the Texas Register (36 TexReg 282), the Em-
ployees Retirement System of Texas (ERS) reviewed 34 Texas Admin-
istrative Code (TAC) Chapter 87, Deferred Compensation, pursuant to
Texas Government Code 2001.039, to determine whether the reason
for adopting the rules in Chapter 87 continues to exist. No comments
were received concerning the proposed review.
As a result of the review, the ERS Board of Trustees (Board) has de-
termined that the reason for adopting the rules in 34 TAC Chapter 87
continues to exist and, therefore, the Board readopts Chapter 87. This
completes ERS' review of 34 TAC Chapter 87, Deferred Compensa-
tion.
