Summary of Opinion H-1001
Request from Wilson E. Speir, Director, Texas Depart-
ment of Public Safety, Austin, concerning the base mu-
nicipality of a certificated common carrier motor car-
rier.
Summary of Opinion: The base incorporated munici-
pality of a certificated common carrier, as referred to in
the second proviso of Section 1(g). Article 911b, Ver-
non's Texas Civil Statutes, is the city or cities named in
the carrier's certificate of public convenience and
necessity. Transportation services by a certificated
motor carrier, in order to be exempt from regulation as
incident to otherwise regulated transportation under
the second provisio of Section 1(g), Article 91 lb, must
be between points in the base incorporated munici-
pality and cities immediately contiguous and another
point authorized in the certificate of public convenience
and necessity.

the constitutionality of HBi 1875, relating to abortions.
Summary of Letter Advisory: Portions of HB 1875,
which would establish a system regulating abortions,
pose constitutional problems. Those portions of the bill
are (1) the legislative finding that viability occurs at 22
weeks or earlier; (2) the requiring of a certain standard
of care for abortions occurring after the 20th week in-
stead of merely after viability; (3) the failure to ade-
quately define certain terms in connection with the
act's conditional prohibition of the saline amniocentesis
procedure; and (4) the requirement of a positive preg-
nancy test prior to abortion.
