The Department of Public Welfare proposes to amend
the following rules about failure of certified recipients
to participate in the Food Stamp Program. Currently
when a certified household fails to cash an authoriza-
tion to purchase card (ATP) for three consecutive
months, the case is automatically closed and no furtherATPs are mailed. If the household wishes to continue
participation after the automatic denial, a new applica-
tion must be processed.
This proposed amendment adds an additional step prior
to denial of these cases. After three months of non-par-
ticipation, the case will be placed on suspended (hold)
status. No further ATPs will be mailed to the house-
hold, but the case will remain open. Once cases have
been in suspension for two consecutive months because
of non-participation, the case will be closed automat-
ically. Therefore, the proposed changes extend the time
period before a food stamp case is denied for non-parti-
cipation from three months to five months. The result
of the extension is that if a certified household wishes
to resume participation, and the case is open, a new ap-
plication is not necessary, whereas a new application is
required any time a case has been denied. These
amendments are necessary to bring the department
into compliance with United States Department of
Agriculture (USDA) policy.

John H. Reagan Building, Austin, Texas 78701, within
30 days of the publication of this Register.
These amendments are proposed under the authority of
Article 695c, Texas Civil Statutes.
.015. Holds.
(a) In PA and Non-PA cases, a hold will be placed
on the ATP [ATPs] if:
(1) The certification period expires and the
worker has not authorized a new certification period, or
(2) if the client fails to redeem his/her ATP
for three consecutive months.
(b) When either of these two things occurs [this
happens], the hold code is entered directly in the
system.
.016. Failure to Participate.
(a) When a household fails to redeem [cash] an
ATP for three consecutive months, the case is automat-
ically placed on hold (closed) and no further ATPs will
be [are] mailed. However, if the case has a positive
action or reinvestigation date entered within the
previous months, the case will not be placed on hold
at that time. The worker will be notified that cases
have been placed on hold for non-participation.
(b) Reports should be made to contact house-
holds otherwise eligible in order to determine if they
still desire to participate. If the client wishes to con-
tinue in the program, the hold will be released and,
if the certification period has not expired, the house-
hold will continue participation. If the certification
period has expired, a new application must be pro-
