It is with great reluctance and a heavy heart that I am forced by a sense of
duty to the League, because of the horrendous financial straits in which we
find ourselves,to file charges of misconduct and mismanagement, in violation
of our constitution, against Jose Benites, Immediate Past National President,
and Fidel Davila, Immediate Past Executive Director. I do not and cannot
dispute that many positive things were done on behalf of our people during
their tenure of office. It should be noted,however, that each failed to
answer repeated requests for financial statements, budget information, and
phone calls inquiring as to the League's financial condition, which, in retro-
spect, may have been done for the purpose of continuing their unapproved
activities, or for other equally invalid, and unconstitutional purposes.
I, therefore, must charge Jose Benites, and Fidel Davila with violations of the
LULAC Constitution, Article XI, "Financial Provisions", Section 2, "Budgets",
subsections "a" and "b", in that they failed to comply with subject provisions,
and violation of Article VI, "National Officers", Section 7, "Impeachment and/or
Removal of National Officers," subsections a. (2), (4), and (5), in that Jose
Benites and Fidel Davila did borrow and spend monies in a reckless and irres-
ponsible manner, specifically, borrowing $40,000 from The LULAC National
Education Service Center, which was not authorized, and continues to hamper
refunding except on a month-to-month basis, and borrowing approximately
$100,000 from Banco 1nternaciona1 of Tucson, Arizona, also without the
knowledge and approval of the Supreme Council, and possibly by misrepresenta-
tion to said bank, and spending sums to various and sundry vendors, that are
still due and owing, a list of said vendors having been made available to
supreme council members on several occasions.
