Federal marriage amendment dies in Senate
Supporters fall 11 votes shy of majority needed to force
up-or-down vote on measure to ban legal gay unions

The Senate on Wednesday rejected
a constitutional amendment to ban gay
marriage, killing the effort at least for
this congressional session.
The 49-48 vote fell 11 short of the
60 required to send the matter for an
up-or-down tally by the full Senate.
The amendment would have to pass
the full Senate by a two-thirds majori-
ty, or 67 votes.
Supporters said the vote reflected
growing support for the federal
amendment among senators and
Americans.
"We're building votes," said Sen.
David Vitter, R-La., who is among
supporters of the ban who were not
members of the Senate when the
amendment was last voted on in 2004.
"That's often what's required over
several years to get there, particularly
to a two-thirds vote."
But Patrick Guerriero, president of
Log Cabin Republicans, called that
idea laughable.
"Supporters of this amendment
couldn't even
get 50 senators
supporting the
procedural
vote.... It takes
67 votes to pass
this amend-
ment, and more
than half of the
Senate has said
they couldn't
support this on an up-or-down vote,"
Guerriero pointed out that "as many
as a dozen" Republican senators had
voiced reservations about the amend-
ment, led by Sen. Arlen Specter of
Pennsylvania, who called the amend-

gathering in Fort Worth this weekend
for the Texas Democratic Convention,
according to local GLBT Democratic
leaders.
One big draw for them is Glen
Maxey's campaign as the first openly-
gay candidate for state party chair.

director of Equality Texas and has
been a force in the Democratic party
for 30 years.
Shannon Bailey, president of
Stonewall Democrats of Texas, said
that at least 75 GLBT delegates are set
to attend the convention.
"Those are just the ones we know of
for sure, the ones from local Stonewall
chapters," Bailey said. "There will be
a lot more GLBT delegates than that
who are there."
He said about 5,200 delegates and
3,000 alternates are expected to attend.
Jesse Garcia, spokesman for

are considering a proposal to add
domestic partner benefits to the
agency's employee compensation
package, according to a DART
spokesman.

Morgan Lyons, manager of media
relations, said the proposal arose dur-
ing a review of the agency's policies
that began early this year.
Management teams are studying
salaries and benefits, including health
insurance, retirement and paid time
off, he said.
The group studying health insur-
ance benefits is expected to make a
recommendation about the benefits to
the executive office in about 90 days,

"The next step is for the work group
to make some decisions and make
their recommendations," Lyons said.
"Then we'll see what goes from
there."
Lyons said the proposal was made
by employees who want domestic
partner benefits to be offered.
David Schulze, a DART lawyer,
said he approached the group studying
health insurance benefits and asked its
members to consider recommending
the addition of domestic partner bene-
fits.
"I wanted to make sure manage-
ment was aware there were employees
who were concerned about this issue,
and we wanted to have it discussed,"
Schulze said.
Schulze formerly worked for the
Dallas city attorney's office and was
responsible for drafting the 2002 revi-
