WHAT IS
COM.rflNITY PROPERTY?
The ancient Goths were an ag-
gressive people who spread over
most of Europe l>y the sixth cen-
tury. It is said that the women
fought alongside their men and
thus became entitled to half the
spoils of war.
The laws of the Goths went with
them as they invaded France and
Spain. The French version became
the law of Louisiana, and the
Spanish version became tin* law
of Mexico and its colonies, includ-
ing Texas. Other states where the
community property system exists
are Idaho, Arizona, California,
Louisiana, New Mexico, Nevada,
Washington and, to a limited ex-
tent, Oklahoma.
SEPARATE PROPERTY—
(;OMMrNITV PROPERTY
To determine what community
property is, we must determine
what it is not. Property owned by
a husband or wife before marriage
is that person's separate property.
Property received after marriage
by gift or inheritance is separate
property.
Community property is what is
left. That is, community property

INCOME FROM
SEPARATE PROPERTY
A large part of the trouble 5n
distinguishing separate from com-
munity properly results from the
assumption by many couples that
income from a separate asset is
itself separate. Unfortunately for
those people, the opposite is true.
Income from a separate asset is
half the husltand's and half the
wife's. This includes rent from
separate real estate; rents from
oil leases, covering separate land;
salaries, wages and other earnings
of both husband and wife; interest
and cash dividends on separately
owned securities and1 profits from
separate livestock.
Although community property
can lie converted into separate
property by a written instrument
signed by husband ami wife, it
is against the Texas community
property law to put community
property in the name of husband
j and wife so that on the death of
i one the property will automatically
! I*' owned by the other — called
"joint tenancy."
Those who acquired property in
joint tenancy before moving to
Texas may find it advantageous to
change the arrangement as it also
produces harsh estate tax conse-
quences.
Newcomers to Texas begin to
acquire community property when
they receive their first earnings.
There is no automatic conversion
into community property of assets
brought into the state. They will
remain the separate properly of
the owners if it was separate when
acquired.
Married people who leave Texas
! do not thereby convert their com-
! inunity estate to separate property.
! Texas property, generally speaking,
j if community property at the lime
j of the owners' leaving, will remain
so.
DEATH AND
COMMUNITY PROPERTY
The community is dissolved by
death of one spouse. If there is no
will, the survivor has the right
to continue to manage the com-
munity, lull where the decedent

In the absence of a will, tin1 law
specifes how all properly of a de-
ceased person shall lie distributed.
Community property is inherited
differently from separate property
—another reason why every per-
son should make a will.
For centuries the husband man-
aged the community, including the
wife's earnings. The law was
changed January 1, 1968. It now
virtually eliminates the husband's
traditional right to manage and
placeS the husband and wife on
equal footing.
It provides that each handles
his or her personal earnings and
llu> income from his or her sepa
rule property. Other community
property is subject to the joint
management of the husband and
wife.
Moreover, under the new law,
property held in the name of hus-
band or wife is now presumed to
be "subject to his or her sole
management," and a third person
may safely deal with the spouse
in whose name the property is
registered — whether it Is husband
or wife.
Another new part of the law
provides that in the case of a
permanent separation, disappear-
ance or abandonment by a spouse,
or if one of the spouses lieeomes
unable to manage his share of the
community, the other may apply
to the district court for permis-
sion to manage that property.
The new law was written to give
the wife an equal right with the
husband in the management of
community properly.
SUMMARY
The community property system,
we believe, is the finest pro|>erty
system in the United States, ft al-
lows the wife as well as the hus-
band to participate in the fruits of
their joint efforts. All property ac-
quired during marriage is pre-
sumed In be community property—
thus owned by them equally.
Those with separate property can
keep it thai way by keeping proper
records. Those who wish to con-
vert their community properly to
separate properly may do so by
signing an instrument. Where there
is no will, community ami sepa-
rate properties are inherited dif-
ferently. A gixKl will is essential.

ATTEND FUNERAL
IN WACO
Mr. and Mrs. Alton Ramsey at-
tended funeral services for Robert
Weempe at Connelly Funeral Home
in Waco Tuesday afternoon. Mr.
Weempe, a brother-in-law of Mrs.
Ramsey, died Sunday night from
the effects of a heart attack.

COLLEGE STATION — Three

degree candidates who have applied
for spring graduation at Texas
AJC-M University, announced Admis
sions Dean II. 1.. Heaton. Ileuton
said the May graduating class in
dudes :!X!l students seeking advanc-
ed degrees. 111. I), candidates total
122 and 389 filed for master's de-
grees.
Baccalaureate degree candidates
include 1,137 seniors.
Commencement exercises will be
conducted May 23.

and Mrs. John Beck of Sacred
Heart Parish. Rocknc, and Miss
Juliet Barbara Edelstcin, daughter
of Mr. ami Mrs Albert Edelstcin
of New York City, were married
April -1, at 11 a. in. at the Convento
Santo Domingo, in Bogota, Colum-
bia Padre Gabriel Oviedo, a friend

English Literature following two
years of study at the Universit> ol
Wisconsin, and two years at New
York University, entered the Peace
Corps in August of 1968. She is

Seguin Recently
Raymond E. Waldron, local min-
ister, reported that a record at-
tendance of 1,088 filled the Seguin
High School in Seguin. Texas when
Mr. Eugene R. Brandt, of New
York delivered the climactic dis-
course, "Withstanding The Pres-
sures Of Our Day," at the three
day assembly of Jehovah's Wilnes-
1 ses.
Mr. Brandt emphasized that our
1 time is one of intense personal pres-
sures, producing unusual tension,
i He mentioned three major causes of
j anxiety inflicting all mankind with
abnormal concern, "Earning a de-
cent living, coping with sickness or
accidents, and the insecurity due
to increasing crime and violence."
Closing llic sessions on Sunday
evening Mr. Brandt's subject was,
"Christians Should Lead Honest
Lives." Saturday saw the ordina
tion by water baptism of 21 new
ministers of Jehovah's Witnesses.
Interested persons are again invit-
ed to meetings of Jehovah s Witnes-
ses at their local Kingdom Halls,
which meetings will resume their
regular schedule this week as an-
nounced.

Sacred Heart Parish were guests
of honor at n birthday party. Satur
day afternoon, May 2, held at the
home of their parents.
Terry was nine, May 2nd, and
Glenn eight, May Titli Cowlsiys and
multicolored candles, with the in
scription lopped the chocolate frost
ed cake for Terry, and the while
frosted cake for Glenn.
Games were enjoyed by the
guests, and balloons and coloring
books given as favors.

candy were served to the honorees,
