Our Courts in construing the above article,
hold, that a deed is [ n j ci ly recorded w hen the
deed and certiticate of acknowledgement have
been recorded, and that the balance of said article
is directory.

The Statute docs not in terms require the Clerk
to sign such certiticate. It simply says the Re-
corder -diall note at the foot of the Record the hour,
day, etc.
And since Courts hold that the Rccoid of a
Deed K complete without such Certiticate, and
also that the j art of said article of statute direct-
ing Clerk to make -aid noting at the foot of ihe
record, is directory, our opinion is that the rights
of the parties to such deeds are in no way injured
or in the least impared by flic omission or failure
of the Clerk to sign such Certiticate.

f! he above opinion is self-explanatory, and is
olfered by me in answer to the charges published
against me by T. P. Bishop. It will be seen from
said legal opinion that titles are not etfeetcd by a
failure of the Clerk to sign the Ccitilicates alleged
not t« be signed, and that it was no neglect of
duty on my part not to sign same.
Respectfully, W. II. GRIMMS.
