1862 GENERAL AND SPECIAL LAWS.
at four public places within the district and at the courthouse
door, and said notice shall be published as required in any newspaper
published within the boundaries of said district, but if
no newspaper is published within said district, then the same
shall be published in a daily newspaper of general circulation
published in Harris County, for the time required for County
elections. The election and returns shall be held under the
regulations prescribed by the General Laws of the State of Texas
as modified and set out under this Act in the case of Harris
County. Should the election fail to carry, the Commissioners'
Court immediately shall enter its order declaring the result and
abolishing the district and shall order paid all legal obligations
incurred, including the election costs, from the ordinary road
and bridge funds of the County.
The term "road district" as used in this Act shall be construed
to mean any Commissioner's Precinct or any Justice's Precinct
of Harris County now or hereafter to be created and established,
or any road district that has been or may hereafter be created
by any General or Special Law, whether there are outstanding
Harris County bonds previously voted under the provisions of
Article III, Section 52, of the Constitution or not. No additional
road plan shall be adopted or additional taxes be levied so long
as any road district plan and prior levy of taxes is in effect in
such district.
Road districts may be established by the Court in all cases
consistent with the General Laws except as otherwise provided
herein, and the Commissioners' Court shall constitute the governing
body of any such district with the right to act in its behalf
in the same manner and under the same laws as is provided for
in the case of Harris County, and to sue and be sued in its behalf.
After the expiration of one year from the entry of the order
of the Commissioners' Court establishing any district and levying
a tax in support of a road plan therefor, upon the petition
of one hundred or a majority of the resident qualified electors
owning rendered taxable property within the metes and bounds
of the road district affected praying that said road district be
dissolved and the tax discontinued, the Commissioners' Court
shall set the same for hearing and proceed therewith in the same
manner as is provided in this Act for the discontinuance of a
road plan for Harris County.
The procedure outlined herein for a road plan for Harris
County shall apply to the funds raised from a tax levied for the
road plan of any district, and all State Laws applicable to Harris
County under this Act with reference to contracts, receipt and
disbursement of funds, budgets, and the restriction upon the
expenditure of funds, not in conflict with the terms hereof, shall
apply to similar matters of any road district established hereunder,
provided that the sum total of taxes levied for Harris
County road plans and for the road plan of any road district
created hereunder shall not exceed a total of Forty Cents on the
