Fróm Tuesday's Dally,
This morning at about 4 o'clock
fire was discovered in A. M. Me-
Kinley's grocery store in the south
part of town, on the corner of Stark
and Market streets. The alarm
was first given by the Lindsey fanW
ily, who reside next door to the Mc-
Kinley store, and liy1 this time Mr.
McKinley -and bis family awoke to
find the store enveloped In flames..
As quick as possible, an alarm was
turned in andi nearby neighbors
rushed in to assist in extinguishing
the Are. Before the fire compaijy
could respond the hose from the
Kirby' Lumber company1 had been
put in operation, which no doubt
saved a number of other residences
going up in smoke. The hose

was also put info operation but did
— hut little good as it had no nozzle
on it and It waft rather short. After
the hose wagon arrived a great deal
of trouble was experienced In at-
taching the hose to the water plug. ¡
The store and its contents is a total
loss; the lee cream parlor which
joined the store was also burned
and the building wtóch was Joined,
to the lee cream parlor, formerly
used for a beef market, was also
burned. The residence of John T.
Lindsey caught on fire and it seemed
tor a while that it would be .con-
sumed by the flames ia spite of all
that could he done, The faithful

fire for Mr. McKinley Is estimated
at $3500, which .is covered with!
$2,000 insurance, $1500 Of which waa<
with the Home Insurance company
of New York by • P. B. Curry &
Son.
The $1500 insurant* was on the

The origin of the flre is not
known. At least two or three per-
say that they noticed the store
only a short time before it was seen
ablaze and that no signs of flre
were seen then. The blase seemed
to have started towards the south
end of the store and no one can
assign any reason for it catching on
flre. It is said if it had not been
for the hose from the Klrby mill
that several houses would hare
been burned. As it was. It required
the greatest effort to keep the res-
idence of Mr. McKinJey from being
burned. The windows In the end
of the house next to the store were
broken frpm the heat and the house

ed this morning on acoount of the

Important Ttoad Matters.
A special meeting ot the commis-
sioners' court of Orange county
Texas, was held on the 14th day bf
April, 1905. Present, W. J. Win-
gate, oounty judge, and Commission-
ers Windham, Gravett" and Harris,
,C. L. Goodman, clerk; R. M. John-
son, sheriff, and S. W. Sholars,, Jr.,
oounty attorney, The following
business was transacted and tbe fol-
lowing orders were made, towit:
Ordered that Jake Wallace be and
he is hereby appointed road over-
seer of (he public road from Black's
Perry to Terry precinct No. —, and
W., P. Beauchamp is hereby/ ap-
pointed overseer ,of the Round
Bunch road from, the lower bridlp
on Cow Bayou to where lt'Aitersects
the lower Orange. and Beaumont
road, and Calvin Williamson is here-
by appointed overseer of the ' road
"from Collier's Ferry to Jasper coun-
ty line, precinct No.. 19.
It Is ordered that the county at-
torney be and he Is hereby ordered
to take such steps as he may deem
necessary to have the obstruotlons
now on the lower Orangey and Beau-
mont road west, of W. O. Morgan's
residence removed.
It is-ordered that the order here-
tofore made by " this court at a for-
mer tenn establishing a second class
road beginning where the public
road crosses the Orange and North-
western railroad near S. H. Pere-
to's 'residence ^ thence south 68 W.
18 raras to the right of way Une Of
said road, thencse south 12 3-4 west
889 raras to corner 15 feet west of
the northwest coiner of George F.
Pool's fence, thence parallel said
fence south 3 1-4 west at 720 raras
from 7k raras wide at 1121 raras,
corner In grove of timber on east
line of the Claiborhe west league;
thence with said league line south
48 -1-2' degrees at 468 raras center, of
public road, said road to be 40 feet
wide, be hereby rescinded and an-
nulled and the order allowing dam-
ages to Cairin Pereto and Martin
Cole by reason of the establishment
of said road Is hereby rescinded and
annulled.
It Is ordered that the report of Pe-
ter McDonald, B. D. Ratollft, Henry
La flore and Mitchell Granger, a Jury
of view heretofore appointed by the
court to lay off and work a public
road for the southeast corner qf Al-
fred Chesson tract of land to the
southeast corner of' Joseph Deon's
land be and the same is hereby ap-
proved and the publle road is here-
by established In accordjtmce with
said report, as follows: Beginning
at the southeast corner of Alfred
Chessop tract of land, , thence north
14 1-2 east 217 raraS to the south-
east corner óf Henry Laflore'a land,
Jthenoe north 1-2 west 368 rairas
to his northeast oorner and t he
•orthwest oorner of Llge Young's

dredge now In course of oonstruo-
tlon at Orange, rho hull for another
vessel of the same kind Is to be
laid on the same ways end the ship
yard will be kept in continuous op-
eration . The contract for this seo-
ond dredge hae already been signed
up and the material for lta constitu-
tion la now being gotten out at the
Klrby Lumber company's mill. This
means the continued employment ot
a number of men at this yard, with
the consequent disbursement , each
week of a large amount ot mobey ta
Orange.

The case of A. W. Miller, d
Beaumont, charged with an affray a*
the Southern Pacific depot* was trie
in the county court this morning,
having been a mistrial one day last
Week, and appealed from the Justice
court that rendered a verdict of
guilty, was aoqnitted today. The
plea of the defense was that he act-
ed in self defense which is allowed
by the law- A strong effort was
made by the prosecution to estab-
lish the fact that each person
equally guilty ot an affray.
