To tho Sheriff of the county of Bexar, Greeting:
WH£RBAS, Anthony M. Dignowity of tha
County and £tate aforesaid, has filed in the
offico of the Cleik of the District Court of said coun-
ty, his petition agaiust Duncan B. McMillan, a non
resident of tho Stato of Texas, reprcseutingthaton
tho 20th day of September 1859, said petitioner
acting by Amanda J. Dignowity, his agent, exe-
cuted and delivered to tbe said McMillnn, bis ins-
trument in wilting, to the effect that he had recei-
ved of said Mo>iilUn one hundred and thirty dollars
in part payment of t a tract of land on or near the
Braunfels road, described on the city map of the
city of San Antouio, as Lot No. 3, range 2, district
2, 124 acres, the said McMillnu binding himself to
p -y to said A J. Dignowity, or order, the sum of'
six hundred and thirty dollars, and assume tho city
debt, one but|¿rad and thirty dollars down, and tho
remainder on Ml first day of January, with the us-
ual intorest; and further representing that said
McMillan executed to said petitioner, represented -
by his said agent, his note or duo bill, in substance
as follows, to-wit:
"Due A J. Dignowity or order the sum of $500, .
five hundred dollars with usual interest the first
day of Jan. 1860, it being part of principal due for
Lot No 3, Range 2, District 2, lying on or near the
Braunfels road, 126 acres, see city map.

Thnt snid note was made pnynble to the said
Amanda J. Dignowitty, as tho ageut and «or the
benefit of snid petitioner, that petitioner is tho legat
owner and holder thereof, that said McMillan has
utterly failed to pay the suras of money mentioned
in said duo bill, or any part thereof, to petitioner
or his saiil agent,
Wherefore petitioner prays for citation, &e, for
judgment to cancel said agrcotneut, nnd to re-ve>t
and adjudge the title to said land, in petitioner, or
for judgment against said McMillan for the twit
sum of five hundred dollars, and legal interest
thereon, for costs nf suit and general relief Ac.
And the said A. J. Dignowity having made oath
according to law, that the snid Duncan B McMil-
lan is not í resident of tho State of Texas.
Vou are therefore hereby commandod that you
summon tbe said Dunoan B. McMillan (by publica
tiiin of this citation for four successive weeks pre-
vious to the return day thoreof, in iiie San Antonio

by publication Smilh Noel, whoso residence
according toonth mndo is unknown, lobe and ap-
pear belure Ihe District Court, to be hidden in at.d
for the county ot Atascosa, nt the Court Hour,
thererf, in the town of Pleasanton, on the sixth
Monday after tbe first Monday in March A. t>. 1860.
Then and there to answer the Petiton of Delilah
Noel, filed in enid Court, against tho said Smith
Noel, and alleging in subBtance a* follows, to wit.
That she and the said Smith Noel, were married
in tho State of Kentucky, on the 2'ith day of De-
cember, a d. 1836, and that in 1854, tbey emigra-
ted to this State, that since fbeir marring, afibro-
satd, they lived togothor a* man and wife. She In
all things discharging her duty as the wife of aaid
Smith Noel until about tbo first day of October, a.
D 1856, when without causo or provocation th.
«aid Smith Noel voluntarily loft hero with th. in-
tention of abandonment and has so abandoned her.
or upwards of thre. years, and that the issue of
the said marling, is George W. W. H. Mary J and
G A. Noel, all minora, and thatShe is in possession
of ptoperly to the value or about nine hundred dol-
lars, and praying for a decree desolving the bonds
of Matrimony between her and the said^aith Noel
and fbr tho cuitody of the Children,and that the pro-
perty mentioned b. vested in ber the laid Dcliah
Noel, and for general relief, coit, Ac.
