Sec. 3. Be it further enacted, That whenever information is
lodged before any Justice of the Peace on oath or affirmation,
stating that there is good reason to believe that any-per-
non or porsons have been guilty of a violation of this, law, such
Justice shall ifiue a warrant against the person or persons com-
plained of, notifying him, or them, to appear before him forth-
with, or in siicli time as the Justice laay think proper, and show
causo if any he or they have, why judgement should not be ren-
dered against him or them, for the penalties incurred by this act;
and if found to bo guilty, judgement- shall be rendered lor the
penalty and costs, upon which executjó.n may immediately i-Mio.
Provided, that either party may appeal to the District Court, as
in other cases.
Sec. 4 Be it further enacled. That where any person may
desire to obtain a license for a shorter period than one year, (and
not less than four months) the Treasurer may receive the a-
mount which would ba duo for the time, adding thereto Wieén
percent., and 011 his riooipt, the clerk will,issue a license for
the time corresponding with the amount which had been paid.
See. 5. Ue it further enacted, That in no cases shall the offi-
ces of county clerk and Treasurer be vested iu one person, and

Sec. 1. Bo it enacted by the donate and House of Represen
tatives ofthe Republic of Texas in Congress assembled, That
the provision* ol a joint resolution, approved November 27th,
1841, granting further timo fur the payment of government dues
and the return of field note*, be, and the same is heroby extended
and declared in force nntil the first day of January, 1846.

WHEREAS, by a proclamation issued on the Hth of Febru.
ary, 1840, in contravention of law and treuty stipulations
by Mirabau B. Lamar, (then President.) "the duties on ull wines
the product or France, imported direct Irom any ofthe ports of
France, in French or Texian vessels" were abolished; and in
further violation of law and treaty stipulation's, all Collectors of
Customs were required1 to permit all wines, as afnrsaid.to be ad'
mitted free of duty into any of the ports of this Republic until
this proclamation shall be revolted hy the Presidonl;" And
whereas neither proprioty, policy, nor thejust regard due to iho
right* of our citizens, requires the continuance of such an immu-
nity to nny foreign power: Anil whereas other goveri).n>1!nts h^ve
made the same a cause of complaint to this,
Theiefore, bo ilknown, that I Sain Houston, PresiJent of the
Republic of Texas by virtue of the power vested in me by luw,
do hereby revoke the said proclamation, and require all Collec-
tors ofCustoms in the Republic to demand and receive the duties
imposed upon wines the product of France, imported into Texas
according to the rates established by law, and by iho existing
treaty between the two countries. This proclamation to be iu
force' and take effect from and after the 15th day of February
next. '
In witness whereof] have hereunto signed my name and caus-
ed the great seal of the Republic to be affixed.
Done at the town of Washington the 21st day of Decemberin
the .year of 0111 Lord one thousand eight hundered
